Recording of Council Meetings Policy

 

 

Objective

 

·        To ensure that there is a process in place to outline access to the recorded proceedings of Council.

 

·        To emphasise that the reason for recording of Council Meetings is to ensure the accuracy of Council Minutes and that any reproduction is for the sole purpose of Council business.

 

Statement

 

Recording of Proceedings

 

(1)     Proceedings for meetings of the Council, Electors, and Public Question Time during Council Briefing Sessions shall be recorded by the City on sound recording equipment, except in the case of meetings of the Council where the Council closes the meeting to the public. 

 

(2)     Notwithstanding subclause (1), proceedings of a meeting of the Council which is closed to the public shall be recorded where the Council resolves to do so.

 

(3)     No member of the public is to use any electronic, visual or vocal recording device or instrument to record the proceedings of the Council or a committee without the written permission of the Council.

 

Access to Recordings

 

(4)     Members of the public may purchase a copy of recorded proceedings or alternatively listen to recorded proceedings with the supervision of a City Officer.  Costs of providing recorded proceedings to members of the public will be the cost of the recording plus staff time to make the copy of the proceedings. The cost of supervised listening to recorded proceedings will be the cost of the staff time. The cost of staff time will be set in the City's schedule of fees and charges each year.

 

(5)     Elected Members may request a recording of the Council proceedings at no charge.  However, no transcript will be produced without the approval of the Chief Executive Officer.  All Elected Members are to be notified when recordings are requested by individual Members.

 

Retention of Recordings

 

(6)     Recordings pertaining to the proceedings of Council Meetings shall be retained in accordance with the State Records Act 2000.

 

Disclosure of Policy

 

(7)     This policy shall be printed within the agenda of all Council, Special Council, Electors and Special Electors meetings to advise the public that the proceedings of the meeting are recorded.

Construction Issues 1 Bristol Lane, Mindarie

 

1.           "The residents at, and adjacent to, Salford Promenade in Mindarie would appreciate an explanation as to why the City of Wanneroo has not responded to any of the complaints relating to the construction activates at 1 Bristol Lane Mindarie; refer email correspondence dated 7 September 2013 and 3 October 2013 to the City of Wanneroo (Enquiries <enquiries@wanneroo.wa.gov.au>)."

Due to an Administrative error, this enquiry was not formally acknowledged in writing at the time it was received;  Administration apologises for this occurring.  However, the matters raised are actively being investigated by the City in response to the enquiry.

 

2.           "Please provide a response to the request for information as contained in the email correspondence dated 7 September 2013; namely:-

 

2.1.      A copy of the approved Construction Management Plan for the development at 1 Bristol Lane (refer to Point 20 of Attachment 1, extract from the JDAP approval for the development at 1 Bristol Lane).

2.2.      Notification if the residents were requested to provide input or feedback to the approved Construction Management Plan.

2.3.      A solution to the on-going issue of Marina users not parking in designated parking bays (and parking overnight) in Tacoma Lane, Mindarie."

 

Response from Director, Planning & Sustainability

 

2.1.      The construction management plan (CMP) was not provided prior to the construction commencing as required by the condition of approval. The proponent has since submitted a CMP for the City's approval.  The CMP is currently being assessed and once approved, a copy will be provided to Mr Sturgeon.

2.2.      Condition 20 of the planning approval for 1 Bristol Lane, Mindarie specifically outlined the matters to be addressed in the CMP.  Therefore, Administration is not required to and does not intend to invite public comments on the CMP prior to making its determination.

2.3.      The matter has been referred to the City's Ranger Services who have advised that increased patrols have been undertaken within the area (around Salford Promenade) to address any illegal parking. Since increased patrols have commenced no vehicles have been found to be parked illegally.

 

3.           "Does the City of Wanneroo intend on imposing any penalties or infringements on the Developer for any breaches for operating outside of the allowable working hours (refer to the attached CoW Noise Information Sheet) and/or any breaches to the approved Construction Management Plan (refer 2.1); if the City of Wanneroo does not intend on imposing any infringements or penalties then please provide an explanation as to why not."

 

 

 

Response from A/Director, City Businesses

 

At this point the City's Health Services does not intend to impose any penalties for breaches of the Environmental Protection (Noise) Regulations 1997 for construction noise occurring outside of the permitted times due to there being no substantiative evidence proving that construction noise from that site either occurred outside of the permitted times or was over the permitted levels.  It should be noted that the Regulations do not restrict personnel being onsite or working onsite, it only restricts noise levels outside of the permitted times.

 

Should complaints continue to be received, Health Services can investigate further and if substantiative evidence of breaches is available then enforcement action can be looked at. 

 

Whether any future enforcement action is taken (or needs to be taken) in respect of compliance with the Construction Management Plan, will be addressed on its merits should the need arise in future.

 

4.           "As per the requirements of Australian Standard AS2436:2010, please refer to Attachment 2 (Extracts from AS2436), please provide a copy of the Environmental Impact Assessment and Community Relations Program for the development at 1 Bristol Lane, Mindarie; of particular importance is the reference to the Noise Management Plan."

Under the Environmental Protection (Noise) Regulations 1997 a noise management plan is only required when applying for approval to create construction noise outside of the permitted times.

 

Clause 13 of the Noise Regulations states that the standard noise limits do not apply to noise emitted from a construction site outside of the permitted times (7am to 7pm Monday to Saturday, excluding Public Holidays) if the occupier of the construction site shows that the construction work was carried out in accordance with a noise management plan in respect of the construction site.... approved by the Chief Executive Officer.

 

To date an application for out of hours exemption has not been received for that property, therefore Health Services has not requested a noise management plan, nor should the company create construction noise above the assigned levels and outside of the permitted times.

 

5.           "As per the requirements of the Occupational Health and Safety Act of 1984 (as enforced by Worksafe) please provide details as to how the Health and Safety of the general public as well as the residents, residing adjacent to Bristol Lane, will be protected from the potential of dropped objects from the tower crane installed at 1 Bristol Lane, please refer to the photograph of Attachment 3; for example protection against the slewing of loads above people, residences and cars."

It is the responsibility of the proponent and its contractors to comply with all lawful obligations under Occupational Health and Safety legislation, to ensure the wellbeing of workers and the public alike.  The enforcement of the Occupational Health and Safety Act 1984 does not fall under the jurisdiction of the City of Wanneroo.

 

 

Questions received at meeting

PQ02-010/13    Mr and Mrs R Bartelds, Shoreham Turn, Mindarie

Construction Issues 1 Bristol Lane, Mindarie

 

1.      Why was insufficient notice given to residents in order to address the Development Assessment Panel (DAP) as outlined in Council letter, reference DEV12/1470.  Letters to residents were dated 25 January 2013 however were received on 30 January or later for objections to be raised at the DAP meeting on Monday 4 February 2013?  This timeframe was insufficient to enable residents to complete the required presentation form, no less than 72 hours prior to meeting as required.

 

2.      Can Council advise why only 10 letters in relation to question 1 above were sent to property owners within the area?  Several residents who are less than 70 metres from the construction did not receive a letter.  Why were all homeowners within the estate, which is relatively small, not canvassed?

 

3.      Can details of the City's policy and procedures for road closures be provided?

 

4.      Why has the dust complaint from 1 Bristol Lane not been resolved, as referenced in the City's letter 86.2013.171.1 dated 4 September 2013?

This application was resolved by DAP, not Council.  Questions will be taken on notice.

 

Response by Director, Planning and Sustainability

 

1.      The City's report on the proposed development was required to be provided to the DAP by 25 January 2013.  Letters to submitters indicating the dates of the DAP meeting could not be sent out prior to this date in case meeting times and dates changed.

 

The letters to property owners were posted on the date of the letter, once the report had been submitted to the DAP Secretariat for inclusion on the meeting agenda (25 January 2013).  It appears delays occurred in the delivery of these letters, which is beyond the City's control.  Notwithstanding, one submitter who received the City's letter of 25 January 2013 did make a presentation to the DAP meeting on 4 February 2013.

 

2.      Following an assessment of the application, variations to the development requirements for the subject site were identified to certain aspects of the proposed development.  Based on these variations, letters were sent only to landowners of properties that were considered to be most directly affected by the proposed variations and not in relation to the development generally.

3.      Under Section 3.50 of the Local Government Act: a local government may, by local public notice, order that a thoroughfare that it manages is wholly or partially closed to the passage of vehicles for a period exceeding 4 weeks.  There is a number of requirements for Local Government to undertake before any thoroughfare can be closed to vehicles.

 

Under Delegated Authority Clause 1.9 of the City's Delegation Manual, the Director Infrastructure and Director Planning and Sustainability are able to close roads in accordance with Clause 3.50 of the Local Government Act.

4.      Investigation into this complaint is ongoing and the matter has not yet been finalised.  Site inspections were conducted at the address of the complainant on the following dates:

 

·             29 August 2013

·             9 September 2013

·             20 September 2013

·             10 October 2013

 

         At the 10 October 2013 inspection a Compliance Officer met with the complainant on site.

 

         At the time of that inspection small areas of sand were noted on the complainant's driveway.  The complainant also pointed out dirty windows on their property, however, this appeared to be salt and likely to be as a result of the proximity to the ocean.

 

         It was noted at the time, that the construction of a new residential dwelling at 25 Salford Promenade was also a possible source of some of the sand present on the driveway.

 

         The windblown sand may be from several sources and will require further monitoring, it is likely that some sand has emanated from the development site situated at 1 Bristol Lane and the developers of that site will be requested to address this issue.  

 

PQ03-10/13      Mrs S Winton, Gibbs Road, Nowergup  

Various Issues : Elections, Skybridge, Quinns Foreshore Erosion Community Meeting, Coastal Management Plan, WA Limestone

 

1.      Wished all the Elected Members who are contesting the upcoming local government elections all the best and on behalf of her local community thanked them for the service they have given over the last four years.

2.      In regard to the Skybridge, Council has recently received its DEC approval for the clearing permit. 

 

(a)     When would the approved plan be made available on the City's website? 

(b)     When will a report be presented to Council?

(c)     The SAT decision gave the City two years from 30 August to bring the boardwalk into line, is Council still confident that it will meet that condition?

(b)     Copies of the Yanchep Boardwalk lowering and realignment construction drawings and Rehabilitation Management Action Plan will be submitted to the Department of Planning by 24 October 2013. 

        

         On receipt of advice from the Department a report will be presented to Council on the proposed construction program.

3.      Could you please explain the structure of the meeting and who will chair it?  How long will be allowed for public question time and what is the protocol?  Will Minutes of the meeting be available for those who are unable to attend?  What future community consultation will occur?

The Mayor advised she will be chairing the meeting which will start at 6.00pm followed by presentations from the City of Wanneroo, Department of Transport and also Cardno Engineering Consultants, then questions and answers from the community.  The meeting will run from 6.00-7.30pm, being held at Gumblossom and advertised in the newspapers, City's website/facebook with local residents receiving letters.  Minutes will be taken at the meeting and it is envisaged a further meeting will be held as issues are addressed.

 

4.      At the last Council meeting I asked a question in regard to the Coastal Management Plan and a feasibility study, that if it hasn't happened why not and when will this occur.  The answer provided explains why it hasn't happened and does not say when it will occur, could a supplementary answer be given?

Completion of this study is dependent on budget funds being available to engage suitably qualified consultants to carry out that work.

 

Further Response by Director, Planning and Sustainability

 

An exact timeframe for when the feasibility study will be completed cannot be given at this time. The timeframe for this study is dependent on the finalisation of the Consultant Brief, the selection of an appropriate consultant and the length of time they require to undertake the study. Based on responses to the Consultant Brief (once received), the City will be able to provide an indication of timing for this study.  Administration is aiming to invite responses to this Consultant Brief before the end of this year.

 

5.      When would a further report be presented to Council in regard to the WA Limestone land swap issue?

 

         Response by Chief Executive Officer

 

At this stage the matter is with the State government, the City has asked that the State further review their land holdings in consultation with Landcorp.  Council has written to the Minister requesting his assistance in reviewing the State government's land holding and to correspond back to Council once they have completed this and encouraged the applicant to also seek further meetings with the State government in that regard.  The City's view is at this stage further exploration was required by the State government in their land holdings to assist in the land swap.  It is therefore premature to present a report to Council until a response is received from the State Government.

 

 

 

 

PQ04-010/13    Mr A Crocos, Casserley Avenue, Girrawheen

Item PS04-09/13 Adoption of Amendment No. 125 to District Planning Scheme No. 2 – Portion of Lot 9474 Casserley Avenue, Girrawheen

 

1.      Was this Amendment adopted at the last meeting or is it still a proposal at this stage?

 

2.      While organising a petition of 75 people in the immediate area on this issue, it was found that the few they had school age children could not afford private schooling therefore not a benefit to the community, would this be a reasonable assumption?

 

3.      In regard to the demographics in this area it was considered by the Education Department that the Hainsworth Primary School was no longer necessary and therefore demolished for public and private housing and queried if things had changed that quickly to warrant a new private school?

 

4.      The funds raised by the sale of this land in future is said to be spent on the maintenance of what is left of Casserley and Hainsworth parks, would that not already be an obligation of Council?

 

5.      What is Council opinion that ratepayers in the immediate area will now have to deal with traffic congestion and disruption both during and after construction of the private school plus lose a park so that residents mostly outside Girrawheen can utilise this private school?

These sentiments were raised in the previous submissions the City received on the Scheme Amendment and were contained within the report to Council last month.  I would reiterate the point I raised in response to the public question at the last Council meeting, it really is a matter for Council to determine in dealing with that Scheme Amendment, which is with the Western Australian Planning Commission for its recommendation to the Minister for Planning, and the Minister will make the ultimate decision on whether it proceeds.

Proposed Shade Sails and Eating Huts for Quinns Beach Foreshore

 

In May 2013 a response was received from the City saying Council would consider in the 2013/14 budget deliberations a request for seating, shade sails and eating huts to be provided at the Quinns Beach Foreshore. Has this been considered by Council?  When will construction begin?  If not this year when?

The items requested by Mr Flood have been listed for consideration within the 2014/15 budget deliberation and will be considered alongside other requests received for additional infrastructure of a similar nature throughout the City. At present until the items can be considered through the 2014/15 budget deliberations it is not possible to give any definitive confirmation that the items will in fact be considered as a requirement or any subsequent timeframe for completion should they be determined as necessary.

Mayor Roberts presented to the Director Community Development a framed certificate of the achievement of being the 2013 State winner for the Heart Foundation Healthy Community Award for Councils with populations greater than 15,000.  A clear reflection of the hard work of our Community Development team and what they do within the community.

Will this work include the filter lights at Wanneroo Road and Hastings Street?

Uncertain regarding the works on Hastings Street lighting however the current signage is a requirement of Main Roads for approval to do any works on Wanneroo Road which will include streetscape works to be done by the City and hopefully some road modification works done on behalf of the shopping centre before Christmas.

 

Could the processing of building applications be explained?

In relation to 9 Rosemount Entrance, a plan was lodged and an objection received from a resident which resulted in changes in the plan.  A new plan was submitted and approved.  The original builder went broke and a new builder and private certifier then mistakenly put in the original plans.  City Businesses are in a process with Planning and Sustainability at introducing a better process to ensure this does not happen again.

Cr Steffens presented a petition of 144 signatures requesting that speed cushions be installed on Seagrove Boulevard and Baltimore Drive, Merriwa due to ongoing problems with hoon drivers and deaths recently caused on Baltimore Drive, Merriwa

 

That the petition be forwarded to the Infrastructure Directorate for action.

 

Cr Mackenzie presented a petition of 75 signatures objecting to the proposed Amendment 125 District Plan No. 2 Casserley Park Girrawheen from "Parks and Recreation" to "Private Clubs and Recreation" for the purpose of being sold to the Emmanual Christian Private School to be developed as a High School and possibly other Private Businesses in the future.

 

That the petition be forwarded to the Planning & Sustainability Directorate for action.
