Item Kingsway District Shopping Centre – Local Structure Plan
“1. Did elected members and members of the City of Wanneroo’s administration have lunch with the owners and representatives of the Wanneroo Central Shopping Centre at Portofino’s Restaurant in Hillary’s on or about Wednesday 20th March 2007?
2. At this meeting did any representative(s) of the Wanneroo Central Shopping Centre suggest that the City of Wanneroo should reject the application for the next stage of Kingsway City Shopping Centre?
3. Did the representative(s) from Wanneroo Shopping Centre ask the elected members present at that lunch how they would vote when the Kingsway City application came before council?
4. Did any elected member(s) indicate in any way whatsoever that they would oppose the Kingsway City Application when it comes before Council?
5. Has any elected member(s) who attended that lunch, either subsequently or prior to that lunch, met with the City’s Administration in relation to the Kingsway application?
6. If so, what are the details of that meeting?

1. Mayor Kelly, Crs Monks and Newton and Acting Directors of Corporate Services and Governance & Strategy had lunch with the Wanneroo Central Shopping Centre representatives at Portofino’s Restaurant at Hillary’s on 20th March 2007.
2. Yes. Mayor Kelly indicated that any decision of Council would be based on its merits and the Mayor then concluded the conversation on this matter.

9. The WAPC has a range of policies on a variety of planning matters. Depending on the type of policy, its role may vary from simply providing guiding principles to statutory requirements. The City’s decision making is guided to this extent.
Questions received at the Council meeting
Question 1 – Item PD04-05/07 Proposed Structure Plan for the Madeley District Centre (Kings way City)
Stated he represented the owners of the Wanneroo Central who are concerned with the proposal to expand the Kingsway City Centre and the potential undermining of the Council’s adopted retail hierarchy and the impact on the Wanneroo Town Centre.
Enquired why the recommendation in relation to the Kingsway City Structure Plan was amended from advising the proponent that a decision of Council is not appropriate or necessary to a refusal?

Question 2 – Item PD04-05/07 Proposed Structure Plan for the Madeley District Centre (Kings way City)
Asked if Council had received legal advice in relation to whether the current officer recommendation and/or the alternative motions would constitute a legal decision particularly in relation to the process surrounding the applications?

Question 1 – Item PD01-04/07 Modification to Proposed Amendment No. 20 – East Wanneroo Structure Plan – Cell 6, Agreed Structure Plan 8
Stated that he attended a Council meeting in November on the same subject and received Council support regarding not changing the R20 to R40 and was now seeking Council’s advice. Mr Hendry had written three times to the Planning Commission, spoken twice to planning officers and has had received no response to his letters. During his last discussion he had with a planning officer he was advised they were was too busy to reply to letters. He has written to the Minister and also the Premier, both of whom have referred it back to the Department.

Acknowledged the difficulty of the situation and suggested that contact be made with the Acting Chief Executive Officer to seek further advice as well as considering approaching his local member of parliament.
Question 1 – Item PD04-05/07 Proposed Structure Plan for the Madeley District Centre (Kings way City)
Stated he represented the owners of the Alexander Heights Shopping Centre who put in a submission of objection to the above and sought clarification in relation to an earlier response given in the meeting whether he was to take it that council has received legal advice on the original recommendation and not the alternatives?

For the purposes of clarification it was advised that the City was endeavouring to get the report to Council at the earliest opportunity. The recommendation that was contained in the Briefing Report last week was effectively the same recommendation that was part of an earlier draft report however upon receiving advice from the City’s legal advisers following the briefing session, the current recommendation was inserted into the report.
Question 2 – Item PD04-05/07 Proposed Structure Plan for the Madeley District Centre (Kings way City)
In light of the complex nature of the submission presented for the Kingsway Shopping Centre, the complex submissions in objection, the proforma letters of support, the legal advice received and the recommendations presented by Council, it was asked if Council would adopt the recommendation that was presented? It was advised that there are parties that were not in attendance due to the understanding they were likely to receive a rejection to the proposal, so would Council:
a) refuse the application as presented;
b) in light of the alternative recommendations, if one of those is in fact was adopted tonight, would the Council please allow two months consultation with affected parties given the magnitude of the decision that is involved?

It was advised that this item forms part of the agenda and all parties have had access to this and it will be discussed and decided during the meeting.
Question 1 – Winston Park
He expressed concern that over the past three years Administration have advised this is a priority one park however for the last two years has been taken off each year’s budget.
Stated that the use of that area for dumping of landfill has resulted in prickles, rocks, broken glass etc which is dangerous and enquired when this situation would be rectified?

The upgrade of Winston Park has been listed in the draft Capital Works Program in 2007/2008 for consideration by Council.

Asked how Council go through and put all this landfill through and not even level it off properly which is dangerous and needs to be cleaned up?

Acknowledged the point and several councillors have raised the issue and certainly with respect to the capital works it is in this year’s budget for consideration.

Question 1 – Item PD04-05/07 Proposed Structure Plan for the Madeley District Centre (Kings way City)
Stated he represented the owners of the Newpark Shopping Centre and highlighted the fact Newpark is situated only 2kms south of Kingsway within Kingsway’s primary trading area and that they strongly support the recommendation to reject the proposal as submitted. Newpark would be seriously affected by the Kingsway proposals and might not survive as a viable centre and based on the present Kingsway policy Newpark committed to a $3million upgrade last year. Queried if in the interests of orderly planning how could Council possibly ignore the existing commercial centre strategy and the Western Australian Planning Commission’s centre policy, which established a centre hierarchy?

Various Issues
1. In regard to Item PD01-05/07:
a) Has Council any power to have Part 9 in the District Planning Scheme 2 to be reviewed so as to define the ‘silent’ part where there is an opposing view held?
b) What power does the Western Australian Planning Commission to override Council who has elected people by the ratepayers and where this Act in Part 9 is silent?
c) What action can Council take when an operator erects a sign on land for sale as R40 and Council had not made a decision at the time? If a person purchased a block of land prior to a decision by Council, could this have happened here and what would the legal status be?
2. Has Council investigated why the public footpath between Griffiths Road and Canna Place appears to be blocked each end with large limestone blocks?
3. What is the opinion of “Quito” wanting to bulldoze 17.32 hectares of land in Nowergup for a turf farm? Is this item in Kiln Road where some illegal clearing happened in 2005?

1. a) The City can seek to have Part 9 of its Scheme reviewed but any proposed amendments are subject to the approval of the Western Australian Planning Commission (WAPC).
b) The provisions of Part 9 of the City’s District Planning Scheme No. 2 currently require both the City and the WAPC to make a decision. The WAPC is not obliged to make the same decision as the Council and the effect of this is that a decision made by the WAPC can override the Council’s determination.
c) There is little the City can do in respect to misleading advertising. All prospective purchasers are advised to contact the City to confirm zoning and other planning matters relating to their land prior to purchase.

3. Lot 5426 (60) Kiln Road, Carabooda received planning approval for ‘intensive agriculture’ on the 9th of January 2006 and was the subject of investigation in relation to unauthorised clearing. The current approval includes conditions relevant to the preservation of a strip of native vegetation in accordance with a negotiated outcome between the City and the applicant (40 metres).
The scheme definition of intensive agriculture includes the following.
“Intensive Agriculture” means any land or buildings used for trade or commercial purposes for the following:
· the production of grapes, vegetables, flowers, exotic and native plants, fruit and nuts (including market gardens); or
· the establishment and operation of plant and fruit nurseries; or
· the development of land for irrigated fodder product and irrigated pasture (including turf farms).
It should be noted that the applicant is also required to obtain a clearing permit from the Department for Environment and Conservation.

Referred to a document he tabled two Council meetings ago which indicated that his building application was refused however he has been living in the house for two years and sought clarification as a matter of urgency if the building approval was subsequently approved? Could he also be supplied with a copy of the approval if it exists and information of telephone or written correspondence between the Council and my builder?
2. Stated there seems to be some confusion concerning the City’s Cut and Fill Policy and requested he be supplied with a copy of that policy so it can be passed on to ratepayers?
3. Was this Cut and Fill Policy applied solely to his residence or to every building application?
4. If the Cut and Fill Policy was generally applied, what were the dates it was enforced?
5. If it transpires the Cut and Fill Policy was enforced and not valid, what actions does Council propose to take to advise the ratepayers affected over that period?

1. A building application was received by the City from Ventura Homes on 30 December 2004. The application was for a single dwelling at 19 Crivelli Parkway Ashby. Further to assessment and minor modification of the submitted plans a building licence was subsequently issued on12 February 2004.
2. Council does not have a Cut & Fill Policy but does have a Establishing Building Pad Levels, Excavation, Fill and Retaining Associated with Residential Development.
3. The requirements of the Residential Design Codes and the City’s policies are applied to all building and planning applications received by the City .
4. The City’s Establishing Building Pad Levels, Excavation, Fill and Retaining Associated with Residential Development policy was adopted on 1 February 2005. Prior to this date all building and Planning applications were assessed taking into consideration the acceptable development criteria and the cut and fill requirements of the Residential Design Codes
5. It is not envisaged that such a situation will occur. Council has the ability to formulate policy under the provisions of the Local Government Act 19995 and the City’s Town Planning Scheme.

That the City has received advice from the Department of Local Government and Regional Development that Elected Members should be encouraged not to use councillor question time as an opportunity to seek information relating to their private activity.

In accordance with Councils previous resolution of 24 April 2007 (PD09-04/07) and the Direction Notice issued by the City on Soiland Pty Ltd, the soil blending may continue until the end of the 60-day compliance period (2 June 2007) and the removal of the peat stockpile by 2 December 2007. In this regard, the applicant has appealed the decision of Council to the State Administrative Tribunal (SAT) and a Direction hearing is scheduled for 25 May 2007. The City has secured legal representation from McLeod and Co and it is anticipated that the matter will be referred to a subsequent meeting for mediation or full hearing at a later date. It is possible that the member (SAT) may allow an extension to the operations on site, pending a determination of the appeal. Administration will inform elected members of the proceedings in due course.
Enquired how close is Administration to forming the policy for guidance on lobbying of elected members ?

Advised that a meeting has taken place with legal advisers who have assisted in finalising the draft guidelines which will be faxed to the Crime & Corruption Commission and the Department for Local Government and Regional Development asking for their comments by the end of next week with a view to presenting these at the next Council Forum. In the absence of those guidelines it would be suggested that if guidance is needed for lobbying relating to development that the Department has previously issued guidelines to elected members dealing with developers and lobbying associated items with developments.
Cr Cvitan presented a petition from 9 residents stating they have no complaint against the dogs that live at Unit 1, 56 Bloodwood Drive, Marangaroo.
The petition to be forwarded to the Community Development Directorate for action.
Cr Cvitan presented a petition with 105 signatories requesting the urgent attention to Winston Park and for the City’s to honour its promise to landscape, maintain and repair the grounds.

That Council:-
1. DETERMINES that in accordance with Part 9.4.1 (c) of District Planning Scheme No. 2 the proposed structure plan submitted by Shrapnel Urban Planning on behalf of Tah Land Pty Ltd for the Madeley District Centre SHOULD NOT BE AGREED to for the following reasons:
a) the proposal is inconsistent with relevant City and Western Australian Planning Commission policies including the Metropolitan Centres Policy Statement for the Perth Metropolitan Region State Planning Policy and the City’s Centre’s Local Planning Policy and supporting strategy. The proposal is contrary to the intent and provisions of these policies and hence with the orderly and proper planning of the locality.
b) the proponent has not adequately demonstrated the commercial impact that the proposal will have on the existing and planned provision of centres and retail facilities in the locality.
c) the proposal is not consistent with the underlying zoning of the subject site.
d) the proposal does not make suitable alternative arrangements for the provision of the planned community facilities for the locality.
e) The proposal is not considered to be consistent with the best practice urban design and sustainability principles and will not promotes the evolutionary revitalisation and re-modelling of the centre, along ‘main street’ principles, as an integrated, mixed use, safe, attractive and vibrant centre that will provide a community focus.
f) The proposal does encompass the peripheral area so that it properly takes account of and integrates with its surroundings. The scale, bulk, siting, design, connections and the increased level of activity and extent of activity that would occur as a result of the proposal would have an adverse impact on the character and amenity of the locality.
g) The proposal does not make appropriate provision for vehicular traffic either onsite or in respect to the surrounding existing and planned road system. The proposal will lead to significant increased vehicular movements which would impair the functioning of the adjoining road system and result in the intersections of those roads and the onsite access ways being unacceptably congested.
h) The proposal does not make appropriate provision for car parking.
i) The proposal ought not proceed because of the aggregation of planning and development problems that would be caused.
j) Approval to the proposal would cause an undesirable precedent.
2. ADVISES the proponent that it will consider the scale and nature of the centre proposed through its forthcoming review of its Centres Strategy.
3. ADVISES the applicant that the City’s Administration will continue to work with the applicant to address the concerns raised within this report.
4. LISTS for consideration in its 2007-08 budget the amount of $60,000 for the review of its Centres Strategy.

That Council:-
1. RESOLVES, in accordance with Part 9.6.1 b) of District Planning Scheme No. 2, that the proposed structure plan submitted by Shrapnel Urban Planning on behalf of Tah Land Pty Ltd for the Madeley District Centre is satisfactory, including the 32,000m2 retail net lettable area, subject to:
a) the structure plan being modified by the proponent to:
i) encompass the peripheral areas and provide for a high level of integration with the surrounding area in terms of land use, building height, scale, orientation, level of intensity and connections;
ii) provide for the evolutionary revitalisation and remodelling of the centre from a conventional ‘box’ shopping centre to a legitimate main street based mixed use town centre using best practice urban design and sustainability principles;
iii) provide for a robust and legible structure of movement corridors that will provide for high levels of connectivity and pedestrian accessibility between the various elements of the centre and to surrounding areas;
iv) provide statutory clauses and plans that will ensure a diverse mix of uses and housing types are delivered in addition to the retail component, including the vertical integration of housing above the commercial elements;
v) provide for an overall high quality and fine grained public realm including the provision of public plaza’s in central, high activity locations;
vi) provide for a comprehensive transport study which assesses on and offsite impacts, for all transport modes as well as infrastructure requirements necessary to service both the interim and ultimate development scenarios;
vii) provide for a comprehensive analysis and strategy for the provision of car parking at the centre;
viii) provide for best practice ecological sustainability elements including energy, water and waste minimisation strategies and initiatives incorporated into the design and functioning of the centre;
ix) accurately delineate the land reserved under the Metropolitan Region Scheme for Primary Regional Road and Other Regional Road reserves and make provision for a design that would adequately accommodate the ultimate road designs;

a) the structure plan being modified by the proponent to:
i) accommodate no more than 20,000m2 retail net lettable area;
ii) encompass the peripheral areas and provide for a high level of integration with the surrounding area in terms of land use, building height, scale, orientation, level of intensity and connections;
iii) provide for the evolutionary revitalisation and remodelling of the centre from a conventional ‘box’ shopping centre to a legitimate main street based mixed use town centre using best practice urban design and sustainability principles;
iv) provide for a robust and legible structure of movement corridors that will provide for high levels of connectivity and pedestrian accessibility between the various elements of the centre and to surrounding areas;
v) provide statutory clauses and a plan that will ensure a diverse mix of uses and housing types are delivered in addition to the retail component, including the vertical integration of housing above the commercial elements;
vi) provide for an overall high quality and fine grained public realm including the provision of public plaza’s in central, high activity locations;
vii) provide for a comprehensive transport study which assesses on and offsite impacts, for all transport modes as well as infrastructure requirements necessary to service both the interim and ultimate development scenarios;
viii) provide for a comprehensive analysis and strategy for the provision of car parking at the centre;
ix) provide for best practice ecological sustainability elements including energy, water and waste minimisation strategies and initiatives incorporated into the design and functioning of the centre;
x) accurately delineate the land reserved under the Metropolitan Region Scheme for Primary Regional Road and Other Regional Road reserves and make provision for a design that would adequately accommodate the ultimate road designs;
b) the following associated matters being addressed by the proponent:
i) a submission being lodged with the City seeking the rezoning of the site to ‘Centre’ under District Planning Scheme No. 2;

Recommendation
That Council ADVISES the applicant, Allerding and Associates acting on behalf of National Lifestyle Villages that it is not prepared to initiate proposed Amendment No. 65 to District Planning Scheme No. 2 (DPS2) to rezone Lots 4(39) and 5(11) Mornington Drive, Mariginiup from Rural Resource Zone to Private Clubs/Recreation Zone for the following reasons:-
1. Clause 3.17.2 c) of DPS2 provides, inter alia, that Council shall not support any use or zoning that potentially could be incompatible with the carrying out of the priority uses for the Rural Resource zone (which currently applies to the subject land) which are intensive agriculture, horticulture and basic raw materials extraction. The proposed use and zoning potentially could be incompatible with the carrying out of the above priority uses.
2. It is contrary to the objective of Council’s Caravan Park, Camping Grounds and Park Home Parks Local Planning Policy which is to facilitate the provision of parks for permanent living in a manner such that environmental, social and physical planning principles are complied with (see 1) above and 6) below).
3. It is contrary to clause 4. b) of Council’s Caravan Park, Camping Grounds and Park Home Parks Local Planning Policy which provides, inter alia, that Council will have regard to the impact of parks on the Rural Resource Zone. (See 1 above).
4. It is contrary to policy statements P3.1, P3.2 and P3.3 of Council’s Interim Local Rural Strategy Local Planning Policy, in being contrary to the DPS2 provisions relating to the Rural Resource Zone (see 1) above), involving a conflicting use (with it not being demonstrated to the contrary), and involving a potentially incompatible use (with it not being demonstrated that there would be no potential for adverse impacts to the carrying out of the priority resource use in the Rural Resource Zone).
5. It is contrary to provisions 1b., 5g. and 6c. of the Smart Growth Local Planning Policy.
6. In so far as the application relies upon the designation of the subject land as ‘possible future urban deferred’ in the draft East Wanneroo Land Use and Water Management Strategy, that proposed strategy is still only at a draft stage and therefore its land use proposals can only be relied upon to a very limited degree in supporting proposals such as this. Furthermore, even if the strategy had been finalised and showed the subject land in a similar manner to the draft strategy, a proper planning process is required to be undertaken to put in place a sound planning framework for the general area before it is appropriate to consider approval of proposals such as this which may otherwise compromise the ability to put in place such a sound planning framework.

‘Office : means any premises used for the administration of clerical, technical, professional or other like business activities but does not include administration facilities which are required in association with a predominant use on site, and does not include consulting rooms ore medical centres.’
b) The proposed ‘Shop’ is to have a net lettable area of no more than 100 square metres in accordance with the Agreed Structure Plan 2 (Clarkson District Centre), as indicated in RED on the approved plans.
c) The finished floor levels must be at grade with the entrances for the shop and restaurant.
d) The windows proposed for the ground floor uses must not open outwards onto Amazon Lane.
e) An onsite stormwater drainage system with the capacity to contain a 1:100 year storm of a 24-hour duration is to be provided prior to the development first being occupied and thereafter maintained to the satisfaction of the Manager Planning Services. The proposed stormwater drainage system is required to be shown on the Building License submission and be approved by the City prior to the commencement of construction.
f) Any roof mounted or freestanding plant or equipment, such as air conditioning units, to be located and/or screening so as not to be visible from beyond the boundaries of the development site to the satisfaction of the Manager Planning Services.
