Questions Received in Writing Prior to the Council Meeting
Item PD03-09/07 Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) Mclennan Drive, Nowergup
1. Is Council aware that the proposed access and egress of the heavy haulage trucks associated with the proposal would travel along a scenic drive identified by the City’s Local Rural Strategy?
2. Is Council aware that Clause 3.17 of DPS2 sets out that intensive agriculture, horticulture and basic raw material extraction are the priority uses for the Rural Resource zone. The proposed land use does not satisfy any of these land use categories. Furthermore, subsection c) of Clause 3.17 sets out that Council shall not support any use that is, or could potentially be incompatible with the priority uses;
3. Has the applicant acknowledged that the proposal is within an area of a ‘sensitive use’, as subsection i) of Clause 3.17 prevents Council from approving the proposal unless such an acknowledgement in writing accompanies the planning application and is available for public inspection?
4. Given the proposal involves an unlisted use, standards of the Scheme are absent in this instance, meaning that Council shall set the standard that applies to the proposal. On what basis did Council set what standards for the proposed use, having regard to which similar land use?
5. What history and experience does the Council have in dealing with impacts associated with soil blending facilities and what enquiries into this use and its potential impacts were carried out?
6. Is Council aware that the Nowergup Lake and Fauna Reserve is listed in Schedule 5 as an area of environmental and landscape protection? The proposals off site impacts have the potential to severely impact this natural community asset.
7. Pursuant to Clause 6.4 of DPS2, did Council forward the proposal to Dept of Environment, Waters and Rivers Commission for potential airborne or leaching contamination considerations of the proposal on surrounding residents’ homes, environmental pollution and Lake Nowergup and Lake Carabooda?
8. Does Council consider it necessary to obtain its own traffic analysis report on the proposal and its impacts on the local road system and the amenity implications on residents?
9. The Agenda report does not include any comments on the proposal and its strategic impacts on the East Wanneroo Land Use Strategy (EWLUS).
The EWLUS has been developed over the last 3 years with the communities input, however, it appears as though this proposal referred to Strategic Planning to gauge the short and long term impacts of the proposal on the locality?
10. Why haven’t the applicant’s supporting studies and reports been made publicly available for the community to review?

1. The City’s Interim Local Rural Strategy identifies a number of roads as Scenic Drives including Gibbs and Karaborup Roads.
2. The terms of clause 3.17 are noted. With respect to clause 3.17.2(c) the Council is required to determine whether or not a proposed use is incompatible with the carrying out of the uses identified in clause 3.17.2(b).
3. The applicant has addressed the issues associated with “sensitive uses” in the documents provided with the application to Council. A more specific acknowledgment in terms of clause 3.17.2(i) can be sought.
4. The Council considers unlisted uses based on the objectives and purposes of the zone and any standards, which may be applicable to a proposal. In this case issues relating to environmental matters including noise, dust and odour and other matters including traffic, landscaping, fire management and hours of operation are required to be addressed.
5. There are a number of other stockpiles and soil-blending type uses which operate within the City. The proposed use is assessed against the requirements of District Planning Scheme No. 2 and any potential impacts, which are identified, are required to be addressed to the satisfaction of the City.
6. Yes, the Nowergup Lake Fauna Reserve is listed in Schedule 5 of District Planning Scheme No. 2.
7. The City referred the application to the Department of Environment and Conservation.
8. The applicant provided a traffic assessment and management plan. The plan was reviewed by the City’s Infrastructure Planning Unit for consideration and advise regarding traffic matters. The advice received from the Infrastructure Planning Unit is considered sufficient.
9. The East Wanneroo Land Use and Water Management Strategy (now known as “The “Future of East Wanneroo “ report) provides an overall framework for future land use decision making which requires the preparation of other more detailed studies. A land use plan indicates the general concept for possible future development in the study area. The subject site and surrounding area is shown as being zoned “rural”.
10. The application is made to the Council for its consideration. The community’s views have been sought and with the consent of the applicant, the studies can be made available for viewing.
Questions Received at the Council Meeting
Item PD03-09/07- Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Stated that in 2005 they brought the property in Kiln Road, which is a beautiful 10-acre rural retreat and purchased it on the basis of the current MRS and DPS zoning giving the expectation of a quiet rural life. Their house is the closest to the proposed facility at 700 metres distance and the Council’s recommendation for dismissal due to proximity to residents is based on an 800 metre minimum distance.
Their experience from the surrounding turf farms, plant nurseries and intensive agriculture is very occasional use of smelly fertiliser and infrequent traffic noise. The Council’s assessment of the proposed facility states that the area has turf farming, plant nursery and intensive agriculture and hence the soil blending facility will make little difference to lifestyles.
Are councillors aware that people will be eating and enjoying the rural area of their own property less than 600 metres from the proposed plant?
2. Are councillors aware they have a responsibility to ensure that the lifestyle of people is not affected by this type of development application?
3. Do the councillors feel they have real understanding of the differences in the processes of a 12 hour per day, 6 day per week soil blending facility and other local industries? Plants, vegetables and turf all grow very quietly.
4. Would the councillors be prepared to do a tour of the area to see first hand the quiet rural nature of the area that is designated a scenic route?
5. In the MRS the two key land planned uses are rural and industrial. Rural is defined as agricultural, that is animal and food growth, extractive and conservation uses. Industrial is defined as land in which manufacturing, processing, warehousing and related activities are undertaken. The planned activities are to bring in materials, process these and make new products for sale. The planned activities are industrial and do not fit with any definition of agriculture or extractive industries and the Council’s review does not consider the MRS at all.
The Council’s review does consider the DPS but does not pick up on many aspects which do not meet the objectives of a Rural Resource Area. A detailed review of the DPS and MRS rather than the cursory review that appears in the Council’s recommendations may lead to a conclusion to reject the applications.
Are councillors aware that if Council review of the MRS and DPS is found to be negligent then Council may be liable for damages arising from the devaluation of surrounding property?
6. Do councillors proposed a more detailed review of the MRS and DPS and if so would these be undertaken by an independent planning consultant?
7. If an independent expert is consulted would the Council use an expert proposed by the local residents group and if not why not?

1. The City is aware that there are a number of residences in the vicinity of the subject site.
2. The Council is required to assess any application it receives on its individual merits having regard to any potential impacts on the surrounding area.

5. The proposal is required to be determined under the provisions of the City of Wanneroo District Planning Scheme No. 2 where the subject site is zoned rural resource.
It is the opinion of the administration that the proposed use does satisfy the objectives of District Planning Scheme No. 2. The Council may reach a different conclusion.
The Council is required to make a determination under the relevant provisions, where such a decision is lawfully made it is not considered that this could be interpreted as a negligent action.
6. The Council employs its own professional staff to review and assess development applications and to provide advice. When required the Council may engage outside advice.
7. If it was considered necessary to engage a consultant the Council would need to do so in accordance with its procedures for quotations for materials, services and consultants.
Item PD03-09/07- Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Can the Council look for more suitable locations for the soil blending facility similar to what they did for the Water Corporation back in their application in 1997?
The Water Corporation wanted to operate a similar operation in Flynn Drive, Neerabup and the Council’s recommendation after rejecting the application was to encourage them to pursue other locations along Westco Road in Nowergup, which is now being leased by Amazon Landscapes Supplies.
2. Is Council aware that the location and subsequent truck route for the proposed soil blending facility would seriously devalue properties in the area and also affect future small lot subdivision zoning as recommended by the East Wanneroo Land Use Strategy that has not yet been adopted but is a seriously entertained document?
3. The proposal is Nowergup is close to protected flora and fauna reserve, which includes Lake Nowergup as stated under Schedule 5 in the District Planning Scheme No. 2. Can Council not see that the McLennan Drive, Nowergup proposal would be a repeat of Landsdale? Is Council moving one problem to another site, namely McLennan Drive, Nowergup to make the residents happy in Landsdale?

1. The Council could suggest to the applicants that they may wish to investigate other suitable locations for the proposed use. The applicant would not, however, be under any obligation to do so.
2. No evidence has been provided that the proposal, if it were to proceed would, impact on property values. The “Future of East Wanneroo” report identifies that land to the east of the subject site and towards Wanneroo Road may be used for future rural small lot subdivision. In considering the proposal measures are recommended to mitigate the impact on existing and any future surrounding uses.
3. The Council has received the application and is required to deal with it in accordance with the relevant provisions. In doing so it seeks to minimise any impacts through appropriate controls and conditions of any approval should it be granted.
Item PD03-09/07- Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Why did the Council spend million of dollars in 1993/95 to conduct a feasibility study at the request of the Gibbs Road Action Group to carry out a road survey and inspection by the City of Wanneroo engineering department which identified extreme traffic danger to the residents, children and tourists? This necessitated the construction of a major heavy vehicle road being Westco Road in 1995 including reclaiming three acres of his property to alleviate the life threatening heavy vehicle traffic that was previously routed through residential properties on Gibbs Road, why now propose to re-introduce at least 64 heavy haulage trucks per day on the same road after spending that much money?
2. Is Council aware that the residents feel the City has a duty of care to protect the residential and rural uses of these roads from life threatening danger of the incompatible heavy haulage traffic for the proposed soil blending facility?
3. Is Council aware that this proposed industrial development is incompatible with current rural zoning and future small lot subdivision and possible urban?

1. The Council has received the application and is required to deal with it in accordance with the relevant provisions having regard to all matters including traffic movements and safety. Any previous actions undertaken by the City does not preclude it from dealing with other matters as they arise.
2. In considering the proposal the Council is obliged to take into consideration all matters including traffic movements and safety, existing uses and the concerns of local residents.
3. The proposed use is considered having regard to the zoning of the land and the objectives of the zoning. The Council will determine whether or not it believes the use is compatible or otherwise with the current zoning.

1. Is Council aware of Clause 3.17 of the DPS2 setting out the extensive agriculture horticulture and basic raw material extraction as priority uses of the rural zone? The proposed land use does not satisfy any of these land use categories, furthermore sub-section (c) of Clause 3.17 sets out that Council shall not support any use that could be potentially incompatible with the priority uses.
2. Has Council spoken to the school bus drivers, Australian Post, refuse collection service and the street verge contractors in relation to the affects and their views on the increase of heavy vehicle traffic on their routes?

Item PD03-09/07- Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Stated he has been a resident in the area for over 35 years. Queried if the proponent deferred this proposal or withdrawn the application?
2. Can the Council tell us how many times can the proponent defer or withdraw his application? As a community we are concerned with the continual process of making submissions. The original proposal was to use animal manures in the process of composting and because of the objections we stated we find the proposal had been withdrawn. We are now are concerned about the traffic which in the original proposal was 14 trucks a day to shift 50,000-100,000 tonnes material and now we have 64 trucks a day which was going to use Gibbs Road initially and now it is going down to Karoboup Road.
3. The reason for asking question 2 is because people who were invited by letter drop in the area who are greatly concerned about the traffic and the welfare of their families turn up at the council meeting to find out the item has been withdrawn.
4. Does the City know that the company Soiland extracted sand from this site and also dumped hundreds or thousands of tonnes of peat on this site two years ago? It was inspected by the City’s officers and on the minutes from the previous meeting it states it didn’t appear as though there was any dumping. If at all possible could Council please delegate someone to take a sample of that material dna tested to see whether it actually peat and not soil that is relevant to our area? If it is found to be peat or a soil not from the area will they have to re-apply and go through the whole process again?

2. To my knowledge this is the first time the matter has come before Council and the applicant has asked for it to be withdrawn from this agenda. In terms of amendments the applicant makes to the application, there is no limit, but ultimately the Council will have to make a decision based on the information it has available to it at the time the application is considered complete by the applicant and Council.

4. Previous approvals and licences have been granted for sand and limestone extraction from the site. Upon a recent inspection of the site it was not apparent that there had been any recent activity on the site. At a further inspection, Mr Anderson pointed out an area where he stated that soil had been dumped. In terms of having soil tested, the City will contact the Department of Environment and Conservation and ask that it undertake any testing considered necessary. Should any testing be conducted, regardless of its composition, the Council is still required to consider the application before it.

Stated that he owns the property directly opposite Godel Road that he purchased a few years ago not realising this application was going to be put in. He has a real safety concern regarding the road and would ask if Planning has given consideration to his zoning in that area which is general rural and under the Council’s objectives for that zoning is to accommodate agriculture, horticulture and equestrian activities. Has Planning given consideration to the truck movements that are going along in light of the equestrian activities that are carried out?

Item PD01-09/07- Modification to Proposed Amendment No. 20 – East Wanneroo Structure Plan – Cell 6, Agreed Structure Plan 8
Stated that she had lived in Rufus Parkway for five years and she sent a letter last week which has been forwarded to all councillors regarding the rezoning of the five blocks in a row from R20 to R40 in Rufus Parkway. The proposal is for 30% of our street to become R40 which is a large amount out of 20 housing lots.
Would like to see the councillors support the residents as they have done previously as they intend living in the street for many more years to come whereas the landowner and developers will be go onto their next project. The impact on the street would be huge regarding 10 consecutive double garages housing 20 cars in a small street that only has 20 blocks of land. The new subdivision at the end of our street has 27 lots and out of these there are 5 lots proposed to be changed to R40. It is understood if they mixed the R40 in amongst the 27 lots but not 5 in a row in one street.
Could Council please look after the local residents as we have lived there for the past 5-7 years and in this particular instance we do not believe it gives you quality of neighbourhood.

Item CD02-09/07- Gumblossom Reserve Changerooms – Pre Tender Estimate
Stated that the Jacks Soccer Club is very happy and excited with the progress that is occurring with the Gumblossom Reserve Masterplan and wished to thank the Council for all its efforts. New training lights are being installed, a carpark at the southern end of the oval being constructed and now hopefully with Council’s approval the first stage of the building constructed going to tender.
The membership of the community also extend their specific thanks to:
· Fiona Bentley, Shane Spinks, Michael Quirk and the community development team for their combined efforts in driving the project forward;
· Mr Stephen Hart, the architect, who has become known as the Doctor because he has been able to fit six reasonable sized changing rooms into a footprint originally designed for two, now known as the Tardis;
· Minister, Department of Sport and Recreation.
The impact on the community is in helping thousands of children to turn into good sportspersons and assets to the community. One of the women in the Matilda’s international soccer team first played for the Jacks Soccer Club as a child.

Item CR01-09/07- Proposed Stockpiling and Soil Blending Facility, Lot 13 Gnangara Road, Wangara – Reconsideration of Decision
Stated that he had lived in Gnangara for last 14 years.
1. Has Council ever received scientific analysis that characterised the constituents of the stockpile, if so was the Council satisfied with the methodology used to obtained the final result data?
2. Has the City considered the impact that heavy metals will have upon the uptake in vegetation?

1. The only sampling that the City is aware of have been taken by the DEC the results of these samples were reviewed by the DEC and Department of Health and analysed to determine if there were any areas of concern. Whilst the City assisted the DEC in taking the samples, the City is not an expert in analysing the results and is not the responsible authority to take any action deemed necessary.

Item CR01-09/07- Proposed Stockpiling and Soil Blending Facility, Lot 13 Gnangara Road, Wangara – Reconsideration of Decision
Stated that she lived 200 metres from the stockpile in Gnangara.
1. Does the City of Wanneroo have a policy or view that favours the creation of contaminated sites where no records of previous contamination exists?
2. Given the definition under the Contaminated Site Act 2003 would the City of Wanneroo consider the Soiland site a contaminated site and if so would the City of Wanneroo pursue this with the DEC?

1. Has Council received confirmation of the supposed approved hardstand and if not does the City of Wanneroo intend to find out if such does exist and what method would be used to investigate this?
2. If the actions of the Department of Conservation and Environment in licensing and regulating the Soiland facility are found to be inadequate will the City of Wanneroo take appropriate action?

1. The City has been advised by the Department of Environment and Conservation (DEC) that the stockpile complies with all of the licence conditions of the DEC including that a hardstand is in place.
2. The City will ask its solicitors to write to the DEC to highlight a number of concerns regarding the management of the site. The Council at its meeting held on 18 September 2007 decided to write to the Minister for Environment asking that compliance with the current licence be confirmed and to reinvestigate various issues.
Item PD02-09/07- DA07/0411: Planning Approval for Satellite dish – Lot 1862 (168) golf Links Drive, Carramar
1. Stated that she is opposing the satellite dish and was advised last week by email that the Council considered approving the dish subject to planting mature trees to obscure the views of the dish. The dish is currently down in order to allow for a swimming pool to be installed. Due to the location of the new pool the mature trees can now only be planted right next to our retaining wall and our adjoining fence. Would Council please consider the implications of planing mature trees so close to the retaining which I have built and paid for at no cost to the my neighbours.
Could you please advise if the Council is going to stipulate a minimum height for the trees to be planted as the dish is a 3 metre dish which sits on a pole 1.35 metres high?
2. Is there a timeframe for the trees to be planted?
3. Taking the above into consideration would Council please consider the option in granting permission for the dish to be sunken so it is not visible?
4. Can Council confirm they have looked at my neighbour’s property in light of this new pool construction it may not now be possible to erect the dish as per the original plans submitted?

The Council has now approved the application subject to the structure not being visible from the street or neighbouring properties. A pragmatic approach needs to be taken to comply with this condition, so that a reasonable outcome is achieved as soon as practicable. 1. Understand that the water used for the dust suppression is coming from a drainage sump of the peat supply; this sump contains concentrated contaminants from the stockpile and blended systems.
Why is Soiland being allowed to spray this contaminated liquid into the atmosphere as a form of dust control, which will eventually leak back into the water system, or to be blown onto adjacent properties?
2. Does Soiland have any water licence of sufficient volume to maintain dust suppression 24/7 over this vast area and do they have water meters to show the volume used?

1. The dust suppression measures have the approval of the Department of Environment and Conservation (DEC) any question of the water being contaminated must be referred to the DEC.
2. Enquiries with the Department of Water have indicated that Soiland has access to an authorised bore on an adjacent lot. No water meter is currently fitted to the bore, but the Department expect to fit one in the future.

Item PD03-09/07- Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Stated that his question was a technical issue and established his credentials as a civil engineer and an expert in construction materials working on some of the country’s major projects in Perth including the Mount Henry Bridge, Narrows Bridge, The Tunnel etc.
In this submission it states that there will be a 300mm thick base slab on which this material will be placed. The material will have acid sulphate soils which when oxidise will become sulphuric acid. Another quick calculation based on the permeability on the limestone base which would be something like one times 10 to the minus 8 metres a second, 300mm thick, which would be something like a 5 metre pour pressure where you could expect something like 25,000 litres per metre squared per year to go through that base, a very high concentrate. I do actually do the design of buns for sulphuric acid, it requires a very high performance concrete to give a low permeability and to be coated with something like a 2mm thick over lacquer poxy. Therefore what is suggested is completely substandard and do not know if councillors have considered that in their appraisal of the groundwater contamination for the area.
In various areas of the Council’s assessment for example traffic impact, road maintenance, noise monitoring, odour, dust management and groundwater quality, it accepts some conditions must be applied but that they won’t be determined until after approval. As an engineer responsible for specification of conditions on major projects I see no reason why each condition should not be drafted and supported by engineering facts and approved by interested parties before approval is given. What do the councillors see as the impedients to preparing the engineering requirements before approval? Are the council prepared to get expert assistance on each of those areas where conditions are required?

The purpose of the contact was to request that Item PD03-09/07 be removed from the Council Agenda. Given the relatively short time frame including the weekend, it is understood that councillors were not notified until Tuesday evening.
Question 2 – Member for Hillarys Comments in Parliament regarding Prostitution Laws
Stated that in Parliament earlier in the afternoon the Member for Hillarys made a series of comments relating to a proposal that was approved by this Council in Wangara commonly known as the Swingers Club. The proponent is a well-known identity, Marianne Kenworthy.
I understand from a very reputable source through the media that it will appear in Hansard that the Member for Hillarys made a statement that a member of this council who is also a candidate in the Mayoral election has frequented that particular facility and there are some questions about that. I would like to state for the public record that I am certainly not involved in any of the queries or comments made by the Member for Hillarys. I have it on exceedingly good authority that the Mayor is certainly not involved and Cr Goodenough certainly tells me he is not involved either. My question is has Council been officially made aware of the position that has been presented late this afternoon by the Member for Hillarys?

Objective
To ensure that the City of Wanneroo meets its environmental, legal and community obligations for weed management on land it administers, in a manner that is environmentally, socially and economically acceptable to Council.
Statement
The City of Wanneroo Weed Management Policy reflects current trends for weed management in a manner that is environmentally, socially, and economically acceptable whilst meeting the City’s legal responsibilities and obligations.
As part of the State Weed Plan released by the Department of Agriculture in October 2001, the desired roles and responsibilities of Local Governments are to manage weeds on lands under Local Government control, as well as to provide information, coordination and support for community groups involved in weed management activities.
Definitions
Weed: “A plant which has, or has the potential to have, a detrimental effect on economic, social or conservation values.” (National Weed Strategy 1997).
Detail
To achieve the objective the City of Wanneroo shall:
1. Develop long-term plans for weed management in areas under the control of the city in association with all stakeholders. These will take a strategic approach, based on one or more of four defined management options, these being:
· Prevention of weed infestation including proactive planting of endemic species
· Eradication
· Sustained control
· No intervention
Management plans will allow for weed mapping and prioritising of weeds for control plus on-going maintenance and re-vegetation. The City shall prioritise sites for weed management based on the invasiveness, distribution and environmental impact of weeds. A weed management approach shall be taken which involves the gradual control of weeds through best practice chemical and mechanical management that allows natural regeneration of native vegetation (or revegetation in degraded areas). High priority shall be given to weeds listed under the ranking system used by Agriculture Western Australia State Weed Plan (Randall, 2000).
2. Work towards best practice methods for sustained control of weeds for:
· Urban roadsides
· Intensively managed areas of parks
· Rural roadsides
· Nature conservation reserves
· Reduction of fuel loads and to assist with fire prevention
3. Upgrade the standards of roads, footpaths and kerbing in order to minimise weed invasion and to facilitate non-herbicide weed control.
4 Continue to facilitate an on-going reduction in herbicide use in all areas where practical.
5. Encourage partnerships with Local and, State Governments and land owners for management of widespread weed colonies.
6. Monitor and record the effectiveness of all weed control programs.
7. Establish a monitoring process for recording the occurrence, location and abundance of weeds in natural areas including conservation and foreshore reserves throughout the City of Wanneroo, which also incorporates information concerning new weed species.
8. Adopt the following approach with regard to herbicide use:
· Allow the use of the specific herbicides only where their application is justified due to non-herbicide methods being deemed ineffective or cost inhibitive.
· Only herbicides specified by The Principle should be used in natural areas to target specific weeds and minimise impacts on native flora and fauna (eg. frogs).
· Herbicides must be registered by the National Registration Authority in Canberra (NRA).
· Before herbicides are used, consideration should be given to non-spray methods of application.
· Record use of all herbicides and collate the resulting information into annual usage statistics.
· Ensure herbicides used on the City of Wanneroo administered land are applied by registered chemical applicators or Council staff working in accordance with the City of Wanneroo task procedures for spraying of chemicals.
· Introduce selection criteria for contractors to ensure that only contractors using best practice, with specialist knowledge of herbicide use and having proven risk management skills are employed to use chemicals within the City.
· Produce an annual weed control program in March of each year (May for nature conservation reserves) and create an awareness of this program by providing a Public Notice media release in the Wanneroo Community Newspaper by 31 March each year (30 May for nature conservation reserves).
· Incorporate provision in the annual program for the control of weeds immediately following bushfires in nature conservation reserves.
· Notify residents of the weed control program no less than one week before work commences. Advertised information shall include the location, likely time span and the herbicide being used.
· Maintain a No Spray List’ for ‘No Spray Zones’ for residents electing not to have herbicides used abutting their properties. These locations may include road reserves, public accessways, public land immediately adjoining private residences, or in other circumstances where herbicides are used.
· Review the ‘No Spray List’ and the ‘No Spray Zones’ annually to assess the impact of weed control on weed communities.
· In the event that a request arises to make a natural area a ‘No Spray Zone’, each request will be treated individually based on the invasiveness, distribution and environmental impact of weeds. Natural areas will not become ‘No Spray Zones’ based solely on the request.
· Maintain a Register of Complaints regarding herbicide use, with the information provided to the relevant contractor within two hours of notification and associated Officer intervention as required.
Herbicide use in Public Drinking Water Source Areas must conform to Waters and Rivers Commission Statewide Policy No. 2 “Pesticide use in Public Drinking Water Sources Areas” and Department of Health PSC 88: “Use of Herbicides in Water Catchment Areas”.

Items CR01-09/07 and CR02-09/07 were dealt with, by resolution, as the first items of business.
Cr Roberts, Chairperson, expressed the sincere thanks of the City of Wanneroo, Council and Staff to Mr Daniel Simms our Acting Chief Executive Officer as it was his last council meeting. Mr Simms is leaving to take up the role of Chief Executive Officer with the City of Gosnells, another growing council and their gain is certainly our loss. It is understood the challenges of Gosnells will be there and as he has done with the City of Wanneroo will make many remarkable effective inroads to the City of Gosnells and we wish him very well with his family and will miss him significiantly. On behalf of the City of Wanneroo we wish him every best wish.
Mr Simms, Acting Chief Executive Officer, responded by stating he thoroughly enjoyed his time with the City of Wanneroo and working with the Charles Johnson and the Executive Team and in particular with council. One of the great benefits of working at the City of Wanneroo is the relationship that the City’s Executive Team have with the Elected Members and very much enjoyed that relationship during this time.
