Questions Received in Writing Prior to the Council Meeting
Item PD01-12/07 Proposed Planning Processes for East Wanneroo
Following assessment of public submissions received on the draft strategy, a final report entitled “The Future of East Wanneroo – Land Use and Water Management in the Context of Network City” was endorsed by the WAPC and released by the Minister for Planning and Infrastructure in August this year.
Given that Council did not support the original land use concept plan within the draft strategy, do Council support the land use plan within the final East Wanneroo report, and if not, why not? If yes, do conditions apply to their support? If so what are they and how will they impact upon the time frame for implementation of the land use plan?

The City supports the process detailed within Attachment 5 to the report in the current agenda to do with East Wanneroo land use planning. The City encourages the State Government to deliver promised strategies in a timely fashion to assist local decision making.
Item PD01-12/07 Proposed Planning Processes for East Wanneroo
I have lived in East Wanneroo for 13 years; I am a horticulturalist and have been cultivating the land for 13 years. Over the years I have noticed the ground water level has reduced so much, that it has been necessary for deeper bores to be sunk. Water pumps have been less effective making it harder and harder to carry out business. Water allocation is constantly under threat of being reduced and I have been told no further increases will be permitted. As I derive my income and livelihood from the land can Council provide me with a time frame for land use changes, so that I may have certainty as to my future? If a time frame is not currently available when will it be?

Timeframes for land use planning are largely within the State Government’s discretion and the City is supportive of a decision making framework to assist this process as detailed in Attachment 5 to the report on East Wanneroo land use in this agenda.
Item PD01-12/07 Proposed Planning Processes for East Wanneroo
The final WA Planning Commission report on East Wanneroo titled “The Future of East Wanneroo – Land Use and Water Management in Context of Network City” contains a land use concept plan which provides a broad planning process for future land use changes in East Wanneroo. Will this planning process be time bound and if it is not, why not? What is Council doing to progress implementation of the land use concept plan and how long will it take to be implemented?

The timeliness of planning for East Wanneroo is largely in the hands of the State Government and Council is proposing to contribute where it can to studies that will lead to the best outcome for the community.
Item PD01-12/07 Proposed Planning Processes for East Wanneroo
The environmental degradation of wetlands areas is occurring at a rapid rate and if nothing is done urgently to arrist this, the wetlands areas will continue to degrade to a level where the damage is irreversible. The strategy proposes that urbanisation along with the introduction of innovating methods of water harvesting can reverse this trend. Does Council support this proposition and if not, why not? What is Council doing to ensure our wetlands within East Wanneroo survive and are in fact enhanced?

The City is participating in the Gnangara Sustainability Strategy and is supporting the timely delivery of outcomes from other planning studies into East Wanneroo.
PD01-12/07 Proposed Planning Processes For East Wanneroo
a) The future of East Wanneroo Strategy recognised the increasing pressure of the urban front on the East Wanneroo area and recommended that a further sustainability study be completed by the end of 2007. Will that study be completed by the end of 2007 as recommended and if not what proposals does the Council have in place to ensure that land in the East Wanneroo area is opened up for rezoning and development in accordance with residential and community wishes?
b) Figures suggest that after a 3 year period the East Wanneroo area will be faced with a land supply shortage if more land in the area is not rezoned for urban use.
Therefore will the Council permit selected precinct development of areas within the East Wanneroo area or does it propose to unnecessarily hold up all development pending what could turn out be long term bureaucratic power plays and processes?
c) In that respect the proposed Mariginiup urban precinct represents urban front or ‘infill’ growth as it is adjacent to existing urban areas and able to tap into existing infrastructure. It will not place any premature demand on the State government for additional infrastructure. Instead, it will improve efficiencies of existing infrastructure and services. The precinct is:
· in the catchment of the Joondalup and Currambine train stations;
· linked to the existing Mitchell Freeway, via Joondalup Drive;
· close to existing activity and employment centres such as, Joondalup regional centre, Wanneroo Town Centre, Whitfords shopping centre and the Neerabup, Wangara and Malaga industrial areas; and
· adjacent to water, sewer, power, gas and telephone services which can be integrated into the Mariginiup precinct at a cost less than typical greenfields development.
Will the Council support this type of precinct development as action it is urgently needed to address the land supply shortage that will occur in the East Wanneroo area within the next three years and if not why not?

a) The Gnangara Sustainability Strategy is currently programmed to be completed by around July 2009. Work on this Strategy, being prepared by the State Government, needs to be adequately advanced prior to more detailed planning being undertaken. Attachment 5 of the Council Report sets out a planning process for the future of the East Wanneroo area that will deliver a coordinated approach to infrastructure provision and best practice sustainable outcomes.
b) The Future of East Wanneroo Report refers to 1950 ha of existing urban and urban deferred land for the south east Wanneroo area, which equates to 3 to 5 years of land supply. For the whole of the City of Wanneroo area the Report refers to 8200 hectares of urban and urban deferred land, which equates to over 20 years of land supply. It is not therefore considered that there is a land supply shortage in the City. The piecemeal release of small precincts is not supported. It is critical that a proper planning process is followed in implementing this strategy to ensure that best practice sustainable outcomes are achieved. Such outcomes will invariably be compromised if ad-hoc decisions are made. It is therefore considered important to determine the detailed planning process to be followed as soon as possible so that all stakeholders are clear on the matter. The process is set out in Attachment 5 of the Council Report

Item IN04-12/07 Tender No 07043 – Kingsway Sporting Complex Redevelopment – Stage 2
1. Is accepting a revised lump sum tender which corrects numerical errors and alters the final lump sum price contradicting the General Conditions of Contract – Clause 19? – “A Tenderer may be requested to clarify a Tender in any respect before final consideration provided that no variation to the Tender sum is offered.”
2. The tender documents state that the schedule and “The unit rates shall be used for assessment of variations to the Contract Works (ref: pages 357 to 371 of Schedule 1). If the final lump sum price has been adjusted in question 1 above, then how can the schedule be used for evaluation purposes, since the tender schedule items also have to be altered to total the revised final lump sum amount?
3. Does the Local Government Act allow tenders to alter the final lump sum price of a tender after the closing date for that particular tender, and does this not set precedent to other tenders that errors are acceptable?
4. In the event that the above are acceptable could you please provide the relevant procedures and or processes which allow the above to be acceptable in the absence of subjective judgement?
5. The Contract asks for a security bond in the order of $500,000. Has Council conducted a financial background check on both the tendering parties to ensure that this requirement can be met and that the successful contractor has the financial capacity to complete the works?

1. Firstly, it should be noted that at a technical level, the clause being referred to (clause 19) is included in the City's General Conditions of Tender, not General Conditions of Contract. The purpose of the standard provisions within the Conditions of Tender is to provide information to prospective Tenderers regarding a range of issues associated with the submission of and subsequent evaluation of tenders. Clause 19 in particular is intended to reinforce that in deciding which tender would be the most advantageous for the City to accept, a tenderer may be requested to clarify the information provided in the tender (s18 (4a) Local Government (Functions and General) Regulations 1996). The qualification included in clause 19 regarding variations to the Tender sum is to highlight that this is not to provide the tenderer an opportunity to revise its tender, which would impose probity concerns.
The City sought clarification from the tenderer relating to an obvious numerical error made in Schedule 1 - Price Schedule, which was the basis for the tender sum. In seeking this clarification, full confidentiality was maintained and no financial information was disclosed by the City or its officers. By seeking this clarification, the City has fulfilled it's obligation to clarify the error and afforded the tenderer with full fairness whilst maintaining the intent of the tender.
2. The forms included in the tender are not prescribed by any legislation, but have been provided by the City to assist in gathering sufficient information to determine the most advantageous tender to accept. The intention of Schedule 1 - Price Schedule is to provide a detailed project breakdown, which can be assessed by the City's technical officers to ensure that the scope of works has been understood and costed appropriately. For information, the schedule includes the notation that "the unit rates shall be used for the assessment of variations to the contract works". As the two line items were corrected at this level, which flowed onto the tender sum, the schedule maintains its relevance in the evaluation process.
3. The Local Government Act and associated Regulations provide a general outline of procedures to be followed for tenders and establish certain principles of equity and disclosure. The process used by the City in evaluating tender number 07043 is in accordance with the Regulations.
Regardless of whether a precedent has been established or not, the City would consider each circumstance on a case-by-case basis and ensure that probity in tender evaluation and selection process is maintained.
4. The City is satisfied that the evaluation process applied during this tender complies with all its obligations and has gained the added assurance through legal advice. The City is prepared to provide further information on the procedures applied, subject to normal confidentiality restrictions.
5. The tender document asks the tenderer to specify if the tenderer has financial capacity to provide a certified bank guarantee to the value of $500,000 or provide a proposal/confirmation to the retention money arrangements. The recommended tenderer has provided the required information. In addition a financial check was requested and obtained by the City.

1. Is Council fully aware of the poisonous impact on the environment that this same peat dump had in the localities of the Princeton Estate and Roselea in the City of Stirling?

Advised that Council is aware of the history of the soil blending operation. Queried whether Mr Quigley would be available to represent the residents before the State Administrative Tribunal. Mr Quigley confirmed that he would certainly be prepared to represent the residents, subject to his health and availability.

1. If this application is approved by SAT with conditions to widen the sharp corner on Gibbs Road, which is directly in front of my property, how will this affect my land? Will my land be resumed? How will I be compensated? What if I refuse?
2. Under the Environmental Protection (Noise) Regulations 1997, Herring Storer Acoustics classed residents in the area as “Caretakers”. How has that made a difference to the noise sensitive receptors outcome?

1. The matter is likely to be considered by the State Administrative Tribunal (SAT). The City is not able to comment on matters which have not yet been decided.
2. Under the provisions of the Environmental Protection (Noise) Regulations, a residence is considered to be a caretaker's residence if it is associated or attached to, or forms part of, a commercial or industrial premises. These types of premises are expected to be able to receive higher noise levels than for noise sensitive premises such as residential areas. Notwithstanding this, rural premises are classified as noise sensitive premises, which have the same permissible levels as residential premises.
Herring Storer have confirmed that the closest caretaker's residence is located north of Residence 1 - meaning that there is no change in the outcome of the assigned levels, and predicted noise levels to be received at the caretakers' residences would be expected to be similar to the other predicted residences.

Why can’t the City of Wanneroo suggest that the applicants find a more suitable location for this operation, as they did ten years ago when the Water Corporation applied for a similar soil blending stockpile facility in Flynn Drive, Neerabup?

As Gibbs Road, Karoborup Road and McLellen Drive are used recreationally for horse riding, what guarantees can the Council give with respect to the impact of 90 trucks per day will have on the safety of riders and horses?

1. Will the City budget funds to oppose this application if it goes to the State Administrative Tribunal with respect to lawyers, expert witnesses etc? Can the affected citizens have an input into mounting our case in opposition? Can the City assure us that the current staff who recommended approval of this proposal will have no more input if it goes to SAT?
2. The Herring Storer Acoustics report stated that a significant number of residences are classified as caretaker premises under the Regulations. What does that mean?

1. The customary practice is to give community members reasonable access to the City’s solicitors before they represent their case. Whilst staff make recommendations, once Council makes a decision staff are obliged to fully implement any such decision.

1. The City has already appointed legal advisers to assist with this and other matters. Residents will be provided an opportunity to appear as witnesses for the City at any appeal hearing at SAT. City staff will prepare a case for the appeal, fully supportive of Council’s decision on this matter.

What can’t Council undertake the works requested earlier than in the next Budget? Surely the amount of $35 000.00 can be obtained from emergency funding?

Advised that Council doesn’t keep emergency funds, but that it did occasionally have unspent funds from other projects that may be available for reallocation. This issue would be considered over the Christmas period.

Council resolved to allocate funds from the 2007/2008 Capital Works Program – Traffic Treatment, for the construction of traffic management treatments on Kingsway, Landsdale. A further report may be required to Council to reallocate funds to this project
PD02-12/07 Proposed Soil Blending Facility (Including Material Stockpiling and Transportable Buildings): Lot 106 (149) McLennan Drive, Nowergup
1. Is Council aware that the development would see an increase from 10 to 90 trucks per day, irrespective of whether the road can accommodate this traffic volume?
2. The original traffic figures were compiled based on operations being carried out Monday to Saturday. Given that Council’s Administration recommends operation from Monday to Friday, does this mean that the proposed 90 vehicle movements per day would actually increase to compensate for the shorter operation period?

2. Administration is unable to anticipate how the applicant proposes to modify their work practices based on five days a week as opposed to the six days a week operation requested. Given Council’s refusal of this application, the matter will be considered under appeal through SAT.
IN05-12/07 Tender No 07042 – Quinns Rocks Volunteer Bushfire Brigade Station – Tender Submission
Is Council aware that, notwithstanding the fact that the tender costs put forward at the moment are prohibitive, the Quinns Rocks Bushfire Brigade is very committed to working with the City of Wanneroo to build a new station facility?

2. Approval of Bottle Shop in Area Between Hastings Street and Shaw Road & Closure of Shaw Road

a. A development approval was issued for a liquor store in this location on 28 September 2007. With regard to a liquor licence, this is the responsibility of the Department of Racing, Gaming and Liquor. Part of the application, once received, will be referred to the City’s Health Services to issue a Section 39 stating that the premises complies with the Health Act 1911.
b. Yes. A Management Order has been issued and identified a strip of Shaw Road as a buffer and is therefore no longer part of the road reserve.
3. Destruction of Old Growth Trees on Wanneroo Road
What date did the delegated authority give permission for the destruction of the old growth trees on Wanneroo Road? What date were the changes to the technical drawings and engineering drawings handed in? Were the drawings of the land passed by the Engineering or other responsible department at the end of the day?

There was no specific delegated authority given for this purpose, the delegation comes from Council’s responsibility to the WAPC to clear conditions of subdivision approval. Engineering drawings for the Parkmore Ridge – Stage 10 development, in accordance with WAPC Approval 132741, were received at Council on 22 August 2007. These drawings were approved by Infrastructure Planning on 17 October 2007

How many extra corporate vehicles are to be purchased? Is the recent Mayoral car included? What extras to be added if any?

5. Admission of Members of the Public into the Councillors’ Lounge
Do you have a policy on who can be invited into the Councillors’ lounge and by whom? Are all Councillors equal in this area and do you represent all people in Wanneroo equally and fairly, or do you have a discriminatory ruling between people who rent, or who own their own homes and pay rates?

Cr Newton advised that she was invited to attend Joondalup TAFE on behalf of the City of Wanneroo on Monday, 3 December 2007. Councill sponsored seven students to complete a certificate course in landcare and conservation. All 16 students in the course were aboriginal youths, and all those sponsored by the City have either found apprenticeships or full time work. Cr Newton hoped that the City would be able to repeat its sponsorship next year.
Cr Roberts advised that she had been presented with a Certificate of Appreciation by Merriwa Primary School, on behalf of the City of Wanneroo, in recognition of the City’s valuable contribution towards the School’s community art project.
Cr Miles advised that he had received phone calls from residents of Carramar who had received letters notifying them of the fact that this issue would be discussed at tonight’s Council meeting, but that the notification had been received too late for them to arrange deputations. Could this situation be reviewed?

The CEO declared a financial interest in CR03-12/07 and CR04-12/07, due to the fact that they dealt with his Performance Review and Remuneration Review.
The Mayor noted for the record that it is up to individual Elected Members to determine their own Declarations. However, if an Elected Member has more than one financial interest in a particular item, then it is a requirement that all interests be declared.

That Council APPROVES the application submitted by Cardno BSD on behalf of Soiland Pty Ltd in respect to the Soil Blending Facility and associated transportable buildings at Lot 106 (149) McLennan Drive, Nowergup subject to the following conditions:
1. This approval relates only to the area hatched in red on the approved plan and in any case no works or development shall be closer than 7.5 metres to a street alignment or 4 metres to any other boundary in accordance with Clause 3.17.3 of DPS2.
2. The works areas identified on the attached plan shall be marked out prior to any construction, earthworks or vegetation clearing occurring on the site and there shall be no clearing of vegetation outside the identified works area without the prior approval of the City of Wanneroo.
3. A Works Approval shall be obtained from the Department of Environment and Conservation prior to commencement of the use.
4. Site operations, specifically, dust suppression, leachate and runoff controls, and odour and noise controls are to be maintained in an approved manner onsite and in accordance with the Department of Environmental Conservation, Guidelines for the Storage, Processing and Recycling of Organic Wastes.
5. The operator to ensure that noise emissions are in compliance with the requirements of the Environmental Protection Act 1986.
6. Vehicles used on the site (other than trucks making deliveries or collecting material) must not use reversing beepers unless it is demonstrated that no acceptable alternative exists.
7. A ‘Dust and Odour Management Plan’ being prepared to control dust and odours, which may create a nuisance to surrounding properties, during construction and operational stages of the proposed development in consultation with the DEC and to the satisfaction of the City of Wanneroo.
8. The proposed 3000m2 lined basin shall be aerated for odour performance 24 hours per day, 7 days per week with a device approved by the City, unless the City approves an alternative treatment.
9. If directed in writing by the City, the peat stockpile must be hydro mulched in accordance with the City’s requirements. The City may direct that hydro mulching be undertaken not more than once per calendar year, except if the previous hydro mulching is inadequate to prevent dust leaving the stockpile, in which case further hydro mulching may be required.
10. If directed in writing by the City the stockpile must be seeded in accordance with the City’s requirements. The City may direct that seeding be undertaken not more than once per calendar year, except if the previous seeding is inadequate to prevent dust leaving the stockpile, in which case further seeding may be required.
11. Visible dust may not leave the site boundaries.
12. In addition to any other condition, if an officer of the City inspects the site and is satisfied that any of the approved uses is generating an unreasonable amount of dust, or that any of the uses are not compliant with any of the conditions relating to dust emissions, the City may direct, either orally or in writing, that the use shall cease until:
(a) a new dust management plan is submitted and approved; or
(b) the use is brought into compliance with this approval, as the case may be.
13. The materials shall be stored on a suitable hardstand area adequate to contain all materials and surface area water run-off. Details of this area shall be approved by the DEC and submitted to the City’s Development and Health Services for a Building Licence approval, before commencement of any storage activities.
14. The southern boundary of the property shall be landscaped (allowance should be made for fire break requirements), in a manner, which is capable of screening the development from McLennan Drive, to the satisfaction of the City’s Director Infrastructure, prior to the commencement of the use. This landscaping shall comprise native species and be of an advanced stage of growth. The landscaping shall be maintained at all times. A satisfactory landscaping plan indicating species and location shall be submitted to and approved by the City, prior to planting.
15. Strictly NO burning off shall be conducted on-site.
16. Hours of operation shall be restricted to:

17. The preparation and implementation of a traffic management and road maintenance management plan at the applicant’s cost to the satisfaction of the City of Wanneroo to address the following;
a) Existing road condition report (including geotechnical engineers assessment) and proposed upgrading including McLennan Drive, Godel Road, Gibbs Road and Karoborup Road.
b) Truck driver education information to manage the minimisation of exhaust brakes, encourage the use of back loading cartage (i.e. take in material, remove product in one trip) and truck route planning to minimise the impact of additional traffic on the community in the vicinity of Carabooda Lake.
c) Deferring the movement of product during periods of material delivery.
d) A road maintenance plan to address any ongoing impacts on the road system by the heavy haulage vehicles on McLennan Drive, Godel Road, Gibbs Road and Karoborup Road.
All costs associated with satisfying this condition and any associated works are to be met by the owner/applicant.
18. The site access shall be provided with a crossover constructed to commercial standards, and shall be sealed in bitumen for the first 50 metres after that so as to prevent stones, soil, dust and other material being carried onto the road. The remainder of the access road shall be graded and treated with commercial dust suppressant so as to prevent the creation of a dust nuisance. Proposed crossover construction, bitumen sealing and access road grading and treatment shall be subject to a Building Licence application, be approved by the City and constructed in accordance with the approved plans prior to commencement of the use.
19. The preparation and implementation of a fire management plan to satisfaction of FESA and the City of Wanneroo, prior to any soil blending material being brought to the site.
20. The proposed stockpiling area shall be setback from the Lot boundary to accommodate the necessary firebreaks.
21. The stockpiling of material is only to occur inside the 14,000m² ‘storage envelope’ as depicted in the application and to a maximum height of 10 metres.
22. The quantity of blended product to be transported from the site is not to exceed 50,000 tonnes per annum and the maximum quantity of all material associated with the soil blending process (including sand and peat) to be contained on the site at any time shall not exceed 100,000 tonnes.
23. The applicant demonstrating that an adequate water supply can be provided to the property to ensure compliance with dust management measures and fire fighting capabilities to the satisfaction of the DEC, FESA and the City of Wanneroo.
24. The proposed development being secured with an adequate standard of fencing to the satisfaction of the City of Wanneroo.

1. The proposed use is ‘unlisted’. DPS 2 (Table 1) provides guidance where the use of the land is not specifically mentioned. Option C is the most appropriate definition of the proposed use, as the import of soil, stockpile, and development of the product on the site, is incompatible with the resource recovery and intensive agriculture and horticulture activities in the surrounding area, that are complaint with the zoning.
2. The increase in heavy vehicle traffic along local road systems would have a detrimental impact on vehicle and pedestrian safety.
3. Proposed road upgrades and driver education provide no reassurance or guarantees of safe and appropriate use of the roads or the use of preferred routes in the area.
4. The applicant has not demonstrated a viable water supply is available for the suppression of dust and odours emanating from the site, hydro mulching process, or for fire fighting purposes.
5. The applicant has not adequately demonstrated that Acid Sulphate soils or potential Acid Sulphate soils will not be placed on the site.
6. The applicant has not demonstrated that Acid Sulphate soils or other contaminants that may occur within the proposed stockpiling of soil blending materials will not adversely affect the ground water. Existing agricultural, horticultural and other compliant uses rely heavily if not exclusively on the ground water for their products. Further, ‘The Future of East Wanneroo- (WAPC) designates the area immediately adjacent on the north of the subject lot, as a groundwater control area, and is in close proximity to the proposed future rural and agricultural precinct to the north.
7. The proposed use conflicts with the City’s aspirations to develop a tourist drive in this area as supported in ‘The Future of East Wanneroo- (WAPC), where the opportunities for tourism and small rural enterprise are identified.
8. The Future of East Wanneroo- (WAPC) is the guiding document that provides the most compelling guidance to the landowners in that region. The City of Wanneroo endorses local area structure planning prior to any zoning changes.
The land, currently zoned rural, immediately adjacent to the subject site is indicated as rural small lot subdivision which would render the subject proposal an INCONSISTENT use. Local Structure Planning should determine than outcome prior to a potentially inconsistent use taking place.

Community objection to the proposal is extensive, informed and emphatic. There are serious concerns that the proposed use is inconsistent with the existing (and future) zoning and uses and will potentially impact predominantly through lack of water available to properly manage the proposed use, and the leaching of contaminates into the ground water that is the supply that the existing activities rely on for their produce which is their livelihood. Community safety is of utmost concern with the proposed traffic movements considerably in excess of existing movements in the rural area. The road formations and alignments are not intended for the impact of the vehicles associated with the proposed use. Community lifestyle, livelihood and safety are at risk.

That Council RECOMMENDS that the Western Australian Planning Commission approves DA07/0674 to conduct an extractive industry on Lot 8 (259) Wattle Avenue, Nowergup, under clause 32 of the Metropolitan Region Scheme, and requests the Commission to include the following conditions and footnote in its approval:-
1. Planning approval shall be limited to a period of five years from the date of the notice of approval and shall be subject to application being made for and the issue of an extractive industry licence in accordance with the City’s Local Law.
2. The coordination of finished levels, batters and buffers to –
a) Accommodate the design and widening of Wattle Avenue and to integrate with adjoining sites to the satisfaction of the City;
b) Protect Bush Forever Site 293 by clearly delineating it on site with temporary fencing. (Note - If this site is to be retained, it is suggested the buffer area of native vegetation is expanded to between 50m and 100m to reduce potential impact on natural drainage and to minimise edge affects).
c) Protect Lot 10 and its access leg to Wattle Avenue.
3. Upgrading of Wattle Avenue, and its extension to Lot 8, is to be designed, constructed and maintained to the satisfaction of the City.
4. Clearing of vegetation shall –
a) Facilitate fauna movement to adjacent bushland, and is to take place when the main breeding/nesting time has finished.
b) Take place when dieback is less mobile. Machinery is to be washed down prior to entering the site.
c) Retain large hollows logs and the like for use as habitat in rehabilitation areas.
5. No burning of cleared vegetation shall be allowed without prior written approval from the City. The applicant to refer to DEP guidelines for alternative methods of treating cleared vegetation.
6. Hours of work shall be restricted to between 0700 and 1700 Mondays to Fridays, and between 0730-1700 on Saturdays. Work shall not be permitted on Sundays and Public Holidays without prior approval from the City.
7. All stormwater shall be contained on-site, to the satisfaction of the City. Erosion control measures shall be implemented to ensure no sand runoff into the road reserve.
8. The control of dust and sand drift in accordance with Department of Environment and Conservation (DEC) guidelines. Disturbed areas shall be stabilised on completion and thereafter maintained to the satisfaction of the City.
9. No construction work, plant, materials or earthworks (including batters), shall intrude onto adjacent land, road reserves or any proposed POS without the prior approval of the City.
10. Compaction and stabilisation shall be carried out to the satisfaction of the City. Only clean fill shall be used on site.
11. The site shall be progressively rehabilitated in accordance with the Limestone Extraction and Rehabilitation Management Plan prepared for the proponent by Landform Research and which was submitted with the application for planning approval.
FOOTNOTE – That the Water Corporation of WA be advised that the City will be undertaking studies with other agencies to determine the finished contour profile for surrounding land after quarrying of the basic raw material resources.

1. RECEIVE the report prepared by Anne Lake of Anne Lake Consulting on the remuneration review of the CEO’s remuneration package.
2. APPROVE a new five-year employment contract for the CEO based on the contract at (Attachment 2).
3. APPROVE the following Remuneration Package for the CEO:
(a) Salary (cash component) $225,500 per annum
(b) The Motor Vehicle $ 20,000 per annum
(c) Superannuation value $ 33,825 per annum (this figure represents 15% and is contingent upon the CEO contributing 6% of his salary to the superannuation scheme)
Total Remuneration Package $279,325 per annum
4. APPROVE in lieu of future Performance Review payments being paid annually, a loyalty retention payment of $40,000 to be allocated and paid at the completion of the CEO’s contract. That payment will be adjusted each year equivalent to the quantum agreed to being paid as part of the CEO’s performance review process. Subject to extenuating circumstances, which can be reviewed by Council, no payment will be made if the CEO does not complete the full term of the contract.
5. AGREE to the establishment of one additional administrative officer within the Office of the CEO.
