		1.2	Gnangara main sewer should be placed along Wanneroo Road, not within the wetland plain to prevent corrosion of piping infrastructure due to acid sulfate soils.	The Gnangara branch sewer is being planned and constructed by the Water Corporation, and has been subject to public environmental review by the Environment Protection Authority. This is a separate project to the Woodvale Structure Plan.	Nil.
		1.3	Concern regarding risk to human health due to residential allotments adjacent to polluted Wangara Sump.	Site specific investigations by the City of Wanneroo to establish the degree of soil/groundwater contamination within the Wangara sump, indicate that the risks are low and do not require remedial action. The proposed LSP does not increase the potential exposure of future residents to the Wangara Sump as the feature would be fenced and is bordered by right of way reserves. A detailed Area Plan is to be submitted for those lots abutting the sump. A Detailed Site Investigation addressing potential soil and groundwater contamination will need to be undertaken by individual landowners as part of the subdivision process and, if necessary, a remediation plan would be prepared and implemented to negate the risks as part of the subdivision process.	Structure Plan Map 1 to be modified to include annotation over Wangara Sump for development of Detailed Area Plans. Part 1 to be modified to include additional section “Detailed Area Plans” to set requirements for development of DAPs for areas abutting Woodvale Drive, and the Wangara Sump.
		1.4	Proposed wetland buffer is not suitable, and should be increased to a minimum 50 metres, and the entire area rehabilitated. The provision of stormwater retention basins, roadways, dual use paths, sewerage pipes and public open space is not the role of wetland buffers.	A site specific determination of an appropriate wetland buffer was undertaken in accordance with State Planning Policy 2.9 Water Resources and Draft Guidelines for Determination of Wetland Buffers, rather than providing a generic 50 metre buffer. Key values of the wetland relate to water quality and habitat. The Wetland Interface and Landscape Master Plan (Plan 2 of 2) presents offsets to provide enhanced habitat value, and the development of a Local Water Management Strategy will provide for improved water quality outcomes compared to previous polluting land uses. 3	Western Power		Western Power has installed the works described in part 2 of the Schedule, on, under, or over the land to extend or reinforce those works in the manner described in the same schedule. 4	Wanneroo Ratepayers and Residents Association		Members of the Association do not support any development that will encroach into the Yellagonga Wetlands.	Agreed – the LSP does not propose any development within the boundary of the Conservation Category Wetland (CCW) or the Yellagonga Regional Park. The LSP does, however, propose a wetland buffer that extends into privately owned land and a restoration approach to restore the natural values of the wetland and wetland buffer in close proximity to the LSP area. 5	FESA		WAPC Policy DC3.7-Five Planning applies to the proposed Structure Plan.	The Water Corporation has confirmed a potable (scheme) water supply is available to the subject site. Hydrants will be installed in accordance with Water Corporation and FESA requirements as per WAPC Policy DC3.7 – Fire Planning.	Nil.
6	Department of Indigenous Affairs	6.1	Register does not reveal Aboriginal sites in or near the vicinity of the proposed development. The register contains information on areas previously surveyed; this land has not been examined for Sites.	Noted and Agreed.	Nil.
		6.2	Examination of the Register shows many sites recorded in areas that have been subject to heritage surveys. Water is an important locational factor for Aboriginal Sites. Many important sites are centred on rivers, pools, wells, soaks, and estuaries. The proposal is unlikely to have a direct effect on Aboriginal sites, however actions arising may breach S17 of the Aboriginal Heritage Act 1972. If it is envisaged that any Indigenous sites are to be impacted by the actions arising from the Structure Plan, there should be a consultative heritage survey done and a S18 Notice lodged in accordance with the Act.	The individual landowners are aware of their obligations pursuant to the Aboriginal Heritage Act 1972 and it is best that these are addressed (through consultation and S18 notices) at the time of subdivision when the timing and nature of subdivision works are fully known. 		13.2	The installation of a 1,200mm diameter gravity collection sewer along the western edge of the Structure Plan is required to enable waste water servicing of the area. 22	John Chester	22.1	Concern regarding flooding risk from Wangara Sump; the sump has been built up above natural ground surface. Proposed dwellings located near the western end of the sump will be 3-4 metres below the water level.	The existing sump caters for the 100 year storm event before overflowing (via a designated weir structure) into the adjacent CCW. On this basis, even though the basin is built 3-4m above the existing ground level, the basin does not present a flood risk to neighbouring property.	Nil.

		22.3	Suggestion to purchase access into Lot 91 (pg 32 Explanatory Report) is not feasible as the underlying pipe could not be easily relocated as it carries all stormwater from Wangara Industrial Estate.	The relocation of the existing stormwater pipes and assets currently located within the access way to Lot 91 can be readily achieved without compromising the collection of stormwater from the existing Wangara development. This issue will be resolved between the City of Wanneroo and the Consulting Engineers (on behalf of the landowner) when civil drawings are submitted to Council for approval.	Nil.
		22.4	Suggestion to incorporate heavy outflow at Outfall 27 into drainage infrastructure on Lot 83 is not supported as it would be poor engineering practice.	All drainage infrastructure will be adequately sized to deal appropriately with the anticipated design flows. The design process for drainage infrastructure is well understood and will be subject to negotiation and approval with the City of Wanneroo during the subdivision process.	Nil.

		23.5	Question regarding sewage pumping stations. How will sewage disposal be managed if pumping stations on Ocean Reef Road are not constructed when the development is finalised, to ensure no adverse environmental impacts due to overflow.	The subdivision will be serviced by a gravity connection to the proposed Gnangara Branch Sewer. Pumping Stations on Ocean Reef Road are not necessary under the current servicing strategy. The construction of the Gnangara Branch Sewer is a timing issue. If this infrastructure is not in place when clearance is sought from the Water Corporation, the Developer will need to construct a temporary pump station to obtain new titles. It is not the preference to construct a temporary station and pressure main station. On this basis, the Water Corporation is now working to secure approvals for the construction of the Gnangara Branch sewer on the western side of the subject land.	Nil.
		23.6	Concern regarding impact of cats on wetland fauna. Suggest consideration of a covenant on the development to make it a ‘cat-free’ zone in recognition of its significance within a regional park.	See 12.5 above.	Nil.
		23.7	Do not support boundaries of the development extending into Yellagonga Regional Park.	The LSP does not propose any development within the Yellagonga Regional Park.	Nil.
		23.8	Request further information on ingress and egress for the development and traffic measures that will be implemented for residents.	Main Roads WA (MRWA) has confirmed that ultimately, the LSP area will be serviced by extension of the existing T-Junction at Prindiville Drive and Wanneroo Road, with a fourth leg being constructed within Lot 33. MRWA has approved two temporary access locations (both left in / left out) at Lot 801 (the southern tip of the LSP area) and adjacent Lot 23 Wanneroo Road. Cardno BSD Traffic has undertaken a traffic analysis on this proposal and confirmed this is adequate in the interim until the ultimate leg at Lot 33 is constructed, at which time the temporary left in / left out intersections will be decommissioned. An additional permanent access point is also provided at the north end of the development area into Woodvale Drive. These arrangements have been discussed and agreed with MRWA. The detailed design will be subject to negotiation and approval from MRWA and the City of Wanneroo.	Administration recommends that a contribution be made from all landowners within the structure plan towards the modification of the traffic signals on Wanneroo Road to facilitate ultimate access into the area. The cost sharing mechanism will be implemented at the time of subdivision. The Part 1 section should be modified to reflect this arrangement. . The applicant has also suggested that a contribution mechanism be included for temporary access intersections, however, the construction of temporary access roads benefits only the subdivider creating the road to facilitate their own staging plan and should not be a cost shared across the structure plan area.
24	Jennifer Hawkes	24.1	Unsuitable width and use of wetland buffer. Recommend 50 metre natural vegetated buffer for wetland protection and prevention of midge nuisance.	See 1.1 and 1.4 above.	See 1.1 above.

		26.2	Current density does not provide aesthetic outcomes. Suggest high rise development with a corresponding higher ratio of open space.	It is difficult to determine how an increased density would improve the aesthetic outcome of the development. Certainly high rise development would be more prominent and hence likely to have a greater visual impact on a broader area. While high density development could result in the preservation of more open space this would be out of keeping with the character of the area and it is questionable whether this location is appropriate for high rise development, unlike more inner city areas, particularly in light of its proximity to the Yellagonga Regional Park.	Nil.
		26.3	Offer opportunity for community activity, i.e. walking, cycling, community gardening, parks for yoga and tai chi.	The LSP incorporates a Dual Use Path (DUP) linking with the areas to the north and south. This will provide the opportunity for people to walk and cycle. Some areas of the POS will be grassed to provide an opportunity for passive and active recreation. All of the lots within the estate will have some private open space which people may use for gardening. In terms of community gardening, there is limited opportunity for this given that much of the site will be rehabilitated/re-vegetated and the remaining areas grassed and in some instances be used for drainage purposes at certain times in high rainfall events. 		26.4	Sewage line should be sited further east, away from acid sulfate soils.	See 1.2 above.	Nil.
		26.5	The development should meet certain conditions, including:
		26.5.1	·Enhance the resident’s lifestyle.	It is considered that the development will enhance the resident’s lifestyle with access to employment, entertainment, shopping and recreational opportunities all within close proximity of the site.	Nil.
		26.5.2	Provide open space along the Wanneroo road side similar to that which exists for the Wangara side, and not encroach on the 50 metre buffer.	The public open space on the eastern side of Wanneroo Road acts as a visual buffer between Wanneroo Road and the Wangara Industrial Estate. As this is a residential estate the need for a visual screen/buffer is not considered necessary. Given the topography of the site, the public open space for the development should ideally be located to the west, as the site naturally drains in that direction. This enables drainage swales to be incorporated within the public open space as per modern urban water management techniques. No development will encroach on the Wetland buffer, the width of which is determined on a case by case basis.	Nil.
		26.5.3	·Preserve the natural slope of the land.	As much of the natural slope of this site has been preserved as possible.	Section 7 of Part 1 to include additional provision: 7.1.14 Subdivision design shall retain, where possible, the natural slope of the site and avoid retaining walls greater than one metre. As a condition of subdivision, a landscape plan shall be prepare to utilize landscaping to soften the impact of retaining walls facing Yellagonga Regional Park.
		26.5.4	·Preserve views over the land.	As much of the natural slope has been retained as possible. Consequently, the views over the land will be retained as much as they can be.	See 26.5.3 above.
		26.5.5	·Provide a reasonable return on investment for developers.	This is not a valid planning consideration in the determination of this Structure Plan proposal.	Nil.
27	Wetlands Research Association, Inc.	27.1	The proposed development encroaches within the mapped boundary of a Conservation Category Wetland; the sewer for the proposed housing estate is planned to be excavated within the wetland.	See 1.1, 1.2, 1.4, and 23.2 above.	See 1.1 above.
		27.2	An effective buffer zone has not been reserved between the wetland boundary and the proposed developments.	See 1.1, 1.4 and 21.1.	See 1.1 above.
		27.3	The limitations of the high groundwater in the western part of the development have not been recognised in regard to the siting of houses and infrastructure; Hydrological monitoring of groundwater levels in the Swan for over 5 years show that the highest water levels are in October-November. The one-off groundwater measurement in July 2005, with below average late summer to early winter rainfall, does not adequately characterise groundwater levels and should not be the basis for planning.	This statement is incorrect. This site has been the subject of extended groundwater monitoring (quarterly over two years and referenced to other longer term datasets held by the Department of Water). This has enabled the prediction of Average Annual Maximum Groundwater Levels (AAMGL). Earthworks levels will ensure that there is adequate separation between development and AAMGL groundwater levels. This matter has been dealt with extensively in the documentation supporting the LSP and will also be addressed within the Local Water Management Strategy that is currently being prepared.	See 1.1 above.
		27.4	The wetland is underlain by peat, and the margins by peaty sand. Excavation of these soils will result in acid sulphate soil issues, which will directly impact Walluburnup Swamp and indirectly impact Lake Joondalup through surface water flows	See 12.4 above.	See 12.4 above.
		27.5	The Wangara Sump located on Lot 91 is an environmental and health hazard and requires urgent remediation.	See 1.3 above.	See 1.3 above.
		27.6	The wetland is of significant stature for the proposal to be referred to the EPA under Section 38(5) of the Environmental Protection Act 1986.	The LSP is neither a ‘scheme’ nor a ‘proposal’ under the Environmental Protection Act 1986 and therefore cannot be referred to the EPA. The Metropolitan Region Scheme amendment (from Rural to Urban Deferred) occurred prior to the environmental/planning legislation amendments and therefore was not referred or assessed by the EPA. It is important to note that land reserved under the MRS for Parks and Recreation associated with the Yellagonga Regional Park (and confirmed through the boundary of Bush Forever Site 299) was recently acquired by the State and therefore effectively set the boundaries of what land was deemed significant for the Yellagonga Regional Park. Notwithstanding the above, the EPA Service Unit has confirmed that a subdivision application constitutes a ‘proposal’ under the Environmental Protection Act 1986 and the EPA Service Unit would advise the EPA on an appropriate level of assessment (if any) for the proposal. Discussions were also held with the EPA Service Unit about the various wetland buffer approaches (including the potential use of offsets) and it was that confirmed that the generic 50 metre buffers are not applicable and that a site specific buffer should be determined in this instance.	Nil.
				Furthermore, the Structure Plan was also referred to the Department of Environment and Conservation for comment and that Department’s response is included as submission 40.
28	David Hancock	28.1	Support principle of the development. Preference for more intensive mixed and higher density development in proximity to Wanneroo Road, and less invasive and more passive approach to wetland fringe area.	See 1.1, 26.2 and 26.3 above.	See 1.1 above.
		28.2	Risks associated with excavation for the sewer line should not be overlooked; whilst this is not within the applicant’s control, the structure plan cannot be separated from the issue. The community deserves to be reasonably assured by the Water Corporation and, if necessary, independent engineering and DEC approval that the sewer installation will be sound and viable as to environmental safety in the long term. 		28.3	Development should not proceed until the City has fully and adequately committed to deal with the issue of pollution in and arising from the Wangara stormwater outfall basin.	See 1.3 above.	See 1.3 above
		28.4	POS adjacent to the wetland should be intensely rehabilitated and managed over a term of not less than 4 years from the commencement of works in the area.	The timeframes for implementation and maintenance of rehabilitation will be a component of the Wetland Management and Rehabilitation Plan.	See 1.1 above
		28.5	Wetland and buffer should not be utilised for stormwater or runoff abatement.	The buffer distance (that is acknowledged to be less than 50 metres) has been calculated to exclude the stormwater management swales. Therefore there is no intention for stormwater or runoff abatement in either the wetland buffer or the wetland proper.	Nil.
		28.6	The structure plan requires formal agreement between all stakeholders to achieve contribution and shared support of the Yellagonga wetland. A contribution spread over the structure plan area, of less than $1.5 million in June 2008 terms, is a suggested minimum. The agreement should formally involve the DEC, City and possibly the Water Corp. The commitment by the developers may be mitigated by payment from the Water Corp for the sewer access.	Funding for the management of the Yellagonga Regional Park is a State Government matter. Landowners within the LSP will need to directly fund the implementation and applicable maintenance of the Wetland Interface and Management Plan (Plan 2 of 2) that deals with areas within and adjacent to the Yellagonga Regional Park and this is expected to require a considerable financial contribution. 		28.7	Any development should include:

29	Urban Bushland Council WA Inc	29.1	Do not support the proposal. Constraints listed in item 6.1.2 suggest residential development is an unsatisfactory land use at the site, and there is significant potential to affect Walluburnup Swamp.	The constraints listed in section 6.1.2 of the Structure Plan document generally occur outside the areas proposed to be developed under the LSP. The LSP responds to those constraints that extend into the LSP area by not proposing development in those areas (i.e. the wetland and the wetland buffer). A wetland buffer and the treatment of that buffer are an LSP response to the adjacent environmental features (i.e. the CCW and the Yellagonga Regional Park). Residential development has been considered the highest and best use of the site through both the zoning and other strategic State and Local Government documents.	Nil.
		29.2	Do not agree that a “hard edge” between the wetland and new residential lots would allow for a sensitive interface with the wetland.	Using “hard-edges” as a management approach to delineate residential and conservation based land uses is a commonly used technique and is also considered best practice. Using the road as the hard edge also ensures a high level of passive surveillance to discourage activities that may further impact on the wetland and the wetland buffer.	Nil.

The current structure plan ignores some of the basic and important principles of wetland conservation. This is not acceptable in 2008 when water is such a critical resource and so many of the wetlands on the Swan Coastal Plain have been already degraded or totally destroyed.	See 1.1 and 1.4 above. 		33.2	The reservation of an adequate buffer zone (at least 50 metres free of all developments) is the single action that would most effectively ensure the greatest protection for the wetland values. In the absence of this, any promotion of the development as safeguarding or enhancing natural values is meaningless and misleading.	See 1.1 and 1.4 above.	See 1.1above.
		33.3	The proposed sewerage pipe (and any other developments) should be located outside the wetland (and outside the wetland buffer zone).	See 1.2 above.	See.1.2 above.

The development will have no impact on the existing Wangara drainage sump as no flow from the proposed development will enter the Wangara Sump. The 1:5 year stormwater event will be conveyed through reticulated pipe work, culminating in drainage swales at the low point to contain the 1:100 year event. Drainage design will follow Best Management Practices and will be designed in conjunction with a Department of Water / City of Wanneroo Approved Local Water Management Strategy (LWMS). As mentioned previously under 22.1, the Wangara sump overflows into the CCW once it reaches capacity. Neighbouring land would therefore not be at risk of flooding. Detailed Engineering design will ensure this is the case in any event.	See 13.3 above.
		36.2	Concern regarding location of dwellings adjacent to Wangara sump and potential health impacts.	See 1.3 above.	See 1.3 above.

A road cannot be shown adjacent to the southern boundary as a substantial dwelling exists in close proximity to the southern boundary which is to be retained. The same outcome is achieved by the proposed Dual Use Path located in the MRS reserve abutting the development to the south to be constructed at the developer’s cost.	Modify plan to illustrate dual use path located in the MRS reserve to the south, abutting the development.
		40.7	Does not support the buffer proposal due to insufficient information to ensure certainty of implementation of appropriate offsets in line with the EPA Position Statement No. 9 Environmental Offsets. It is noted that the proposed buffer is below that which would normally be recognised for a CCW (50 metres of 1 metre AHD – whichever is larger) and stormwater retention basins are proposed within 50 metres of Wallaburnup Swamp.	See 1.1, 1.4 and 24.3 above. The Wetland Management and Rehabilitation Strategy to be developed will include development of an offsets package to the satisfaction of the DEC. 		40.16	6.11.5 Stormwater Drainage – Question if stormwater retention basins within 50 metres of Wallaburnup Swamp meets ‘best management practice’. The design of stormwater for the LSP area should be supported by the City of Wanneroo and Department of Water.	See 1.1 and 1.4 above. 		40.17	6.11.7 Retaining Walls – A plan illustrating existing a finished ground levels of the LSP area and how they relate to Yellagonga Regional Park should be prepared and agreed by DEC to ensure appropriate integration.
